2626 An Act automatically sealing cannabis records and promoting uniform digital record keeping.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Chapter 276 of the General Laws is hereby amended by inserting after section 100K ¼
3030 2the following section:-
3131 3 SECTION 100K ½ (a) Massachusetts courts shall seal all records created as a result of a
3232 4criminal court appearance, juvenile court appearance or disposition for: (1) the possession or
3333 5cultivation of an amount of marijuana decriminalized by chapter 387 of the acts of 2008; (2) the
3434 6possession or cultivation of an amount of marijuana decriminalized by chapter 334 of the acts of
3535 72016; (3) the possession or cultivation of an amount of marijuana decriminalized by chapter 55
3636 8of the acts of 2017; (4) possession of marijuana with intent to distribute based on an amount of
3737 9marijuana decriminalized by chapter 387 of the acts of 2008, chapter 334 of the acts of 2016 or
3838 10chapter 55 of the acts of 2017; or (5) distribution of marijuana based on an amount of marijuana
3939 11decriminalized by chapter 387 of the acts of 2008, chapter 334 of the acts of 2016 or chapter 55
4040 12of the acts of 2017. 2 of 2
4141 13 (b) Massachusetts courts shall leverage all available financial resources to create uniform
4242 14and digitized record keeping processes that enable automatic sealing of records related to
4343 15criminal court appearance, juvenile court appearance or disposition should criminal penalties
4444 16associated with such appearances and hearings and dispositions be removed from state law.
