2626 An Act relative to the return of firearms.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Chapter 140 of the general laws is hereby amended by inserting after section 123 the
3030 2following new section:-
3131 3 "Section 123A. Notwithstanding any general or special law or regulation to the contrary,
3232 4any person having temporarily stored a weapon with a private business including, but not limited
3333 5to, a licensed retailer under section 123 or a bonded warehouse under section 129D shall be
3434 6entitled to the return of their property.
3535 7 If in the event that said property was transferred to and stored by a private business
3636 8without the expressed written consent of the property owner, no fees may be charged as a
3737 9requirement for the return of said property.
3838 10 Notwithstanding any general or special law or regulation to the contrary, any person
3939 11having temporarily transferred a weapon to a private business including, but not limited to, a 2 of 2
4040 12licensed retailer under section 123 or a gunsmith for, but not limited to, repair, modification,
4141 13warranty work, replacement or maintenance shall be entitled to the return of their property."
