[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE HOUSE, NO. 2756 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to retirement benefits for Kevin Wilder. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. (a) Notwithstanding section 12 of chapter 32 of the General Laws or any 2other general or special law to the contrary, the state board of retirement shall provide Cynthia 3Smith Wilder, the surviving spouse of Kevin Wilder, a lifetime, monthly allowance equal to 62 4per cent of the average annual rate of regular compensation Kevin Wilder received during: (1) 5any period of 3 consecutive years of creditable service for which such rate of compensation was 6the highest; or (2) the period or periods, whether consecutive or not, constituting his last 3 years 7of creditable service preceding retirement, whichever is the greater. 8 (b) Any retirement benefit provided to Cynthia Smith Wilder pursuant to this act shall be 9in lieu of, and shall not be in addition to, any benefits she may have otherwise received from the 10state board of retirement as Kevin Wilder’s beneficiary.
