2626 An Act to enhance retail sales and protect consumers from forced labor.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Chapter 94 of the General Laws, as appearing in the 2018 Official Edition, is hereby
3030 2amended by inserting in Section 1 the following definitions:
3131 3 Business, any retail business or quick service restaurant as defined in this section.
3232 4 Customer-operated point-of-sale (POS) station, also known as self-scanning checkout or
3333 5self-checkout (SCOs or assisted checkouts (ACOs) or self-service checkouts, a designated point-
3434 6of-sale area where customers pay for and bag their own merchandise without interacting with a
3535 7human cashier.
3636 8 Point-of-sale system (POS), any computer or electronic system used by a retail
3737 9establishment such as, but not limited to, Universal Product Code scanners, price lookup codes,
3838 10or an electronic price lookup system as a means for determining the price of the item being
3939 11purchased by a consumer. 2 of 2
4040 12 Quick Service Restaurant, an establishment selling food or beverages where products are
4141 13served to patrons primarily over a sales counter or a drive-up window sales point, where there is
4242 14minimal or no direct service to patrons seated at tables, and where employees are paid at least the
4343 15minimum required hourly wage.
4444 16 Retail Business, a business that sells goods or products for use or consumption by
4545 17individual purchasers, including but not limited to grocery stores, pharmacies, liquor stores,
4646 18cannabis establishments and hardware stores.
4747 19 And again after Section 184E by adding the following section:-
4848 20 Section 184E ½
4949 21 Section 2: Notwithstanding any special or general law to the contrary, any business that
5050 22operates more than one Customer-operated point-of-sale station at any one time per location
5151 23shall be required to offer patrons using said Customer-operated point-of-sale station not less than
5252 24a 25% discount on all goods and services purchased per transaction.
