27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
28 | 28 | | of the same, as follows: |

29 | 29 | | 1 Chapter 94 of the General Laws, as appearing in the 2018 Official Edition, is hereby |
---|
30 | 30 | | 2amended by inserting in Section 1 the following definitions: |
---|
31 | 31 | | 3 Business, any retail business or quick service restaurant as defined in this section. |
---|
32 | 32 | | 4 Customer-operated point-of-sale (POS) station, also known as self-scanning checkout or |
---|
33 | 33 | | 5self-checkout (SCOs or assisted checkouts (ACOs) or self-service checkouts, a designated point- |
---|
34 | 34 | | 6of-sale area where customers pay for and bag their own merchandise without interacting with a |
---|
35 | 35 | | 7human cashier. |
---|
36 | 36 | | 8 Point-of-sale system (POS), any computer or electronic system used by a retail |
---|
37 | 37 | | 9establishment such as, but not limited to, Universal Product Code scanners, price lookup codes, |
---|
38 | 38 | | 10or an electronic price lookup system as a means for determining the price of the item being |
---|
39 | 39 | | 11purchased by a consumer. 2 of 2 |

40 | 40 | | 12 Quick Service Restaurant, an establishment selling food or beverages where products are |
---|
41 | 41 | | 13served to patrons primarily over a sales counter or a drive-up window sales point, where there is |

42 | 42 | | 14minimal or no direct service to patrons seated at tables, and where employees are paid at least the |
---|
43 | 43 | | 15minimum required hourly wage. |

44 | 44 | | 16 Retail Business, a business that sells goods or products for use or consumption by |

45 | 45 | | 17individual purchasers, including but not limited to grocery stores, pharmacies, liquor stores, |

46 | 46 | | 18cannabis establishments and hardware stores. |

47 | 47 | | 19 And again after Section 184E by adding the following section:- |

49 | 49 | | 21 Section 2: Notwithstanding any special or general law to the contrary, any business that |
---|
50 | 50 | | 22operates more than one Customer-operated point-of-sale station at any one time per location |
---|
51 | 51 | | 23shall be required to offer patrons using said Customer-operated point-of-sale station not less than |
---|
52 | 52 | | 24a 25% discount on all goods and services purchased per transaction. |
