point-of-sale stations.  Consumer Protection and Professional Licensure.

An Act to enhance retail sales and protect consumers from forced labor.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 Chapter 94 of the General Laws, as appearing in the 2018 Official Edition, is hereby 
2amended by inserting in Section 1 the following definitions:
3 Business, any retail business or quick service restaurant as defined in this section.
4 Customer-operated point-of-sale (POS) station, also known as self-scanning checkout or 
5self-checkout (SCOs or assisted checkouts (ACOs) or self-service checkouts, a designated point-
6of-sale area where customers pay for and bag their own merchandise without interacting with a 
7human cashier.
8 Point-of-sale system (POS), any computer or electronic system used by a retail 
9establishment such as, but not limited to, Universal Product Code scanners, price lookup codes, 
10or an electronic price lookup system as a means for determining the price of the item being 
11purchased by a consumer. 2 of 2
12 Quick Service Restaurant, an establishment selling food or beverages where products are 
13served to patrons primarily over a sales counter or a drive-up window sales point, where there is 
14minimal or no direct service to patrons seated at tables, and where employees are paid at least the 
15minimum required hourly wage.
16 Retail Business, a business that sells goods or 	products for use or consumption by 
17individual purchasers, including but not limited to grocery stores, pharmacies, liquor stores, 
18cannabis establishments and hardware stores.
19 And again after Section 184E by adding the following section:-
20 Section 184E ½
21 Section 2: Notwithstanding any special or general law to the contrary, any business that 
22operates more than one Customer-operated point-of-sale station at any one time per location 
23shall be required to offer patrons using said Customer-operated point-of-sale station not less than 
24a 25% discount on all goods and services purchased per transaction.
