| 27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 28 | 28 | | of the same, as follows: |
|---|
| 29 | 29 | | 1 Chapter 90D of the General Laws, as appearing in the 2020 Official Edition, is hereby |
|---|
| 30 | 30 | | 2amended by adding the following section:- |
|---|
| 31 | 31 | | 3 Section 39. (1) If an owner of an antique motor car, as defined in section 1 of chapter 90, |
|---|
| 32 | 32 | | 4discovers that the car mileage in their certificate of title was documented incorrectly upon |
|---|
| 33 | 33 | | 5transferring the certificate of title, under section 15, and after a new certificate of title in the |
|---|
| 34 | 34 | | 6name of the owner was issued by the registrar, under section 19, then the owner may appeal to |
|---|
| 35 | 35 | | 7the registrar, by mail or delivery of the certificate of title to the registrar, to correct the car |
|---|
| 36 | 36 | | 8mileage in the certificate of title. When appealing the certificate of title, the owner may include |
|---|
| 37 | 37 | | 9an affidavit or any other documentation in order to prove that the car mileage was incorrectly |
|---|
| 38 | 38 | | 10documented. |
|---|
| 39 | 39 | | 11 (2) If the registrar finds that the car mileage in the certificate of title was documented |
|---|
| 40 | 40 | | 12incorrectly when transferring the certificate of title, then the registrar shall issue a new certificate 2 of 2 |
|---|
| 41 | 41 | | 13of title, with the correct mileage of the antique motor, in the name of the owner and mail it to the |
|---|
| 42 | 42 | | 14owner’s address. An appeal of the register’s ruling in this section is subject to section 30. |
