2929 An Act authorizing the City of Northampton to grant seven (7) over quota licenses for the sale of
3030 all alcoholic beverages to be drunk on the premises.
3131 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3232 of the same, as follows:
3333 1 SECTION 1. Notwithstanding section 17 of chapter 138 of the General Laws or any other
3434 2general or special law to the contrary, the licensing authority of the City of Northampton may
3535 3grant seven (7) additional licenses for the sale of all alcoholic beverages to be drunk on the
3636 4premises, under section 12 of said chapter 138, to seven entities deemed appropriate by the
3737 5licensing authority of the City of Northampton. The licenses shall be subject to all of said chapter
3838 6138, except said section 17.
3939 7 The licensing authority shall not approve the transfer of a license granted pursuant to this
4040 8act nor shall a license be marketed for sale, sold or pledged to any other entity or location. For
4141 9purposes of this paragraph, a conveyance or transfer of more than forty-nine percent interest in
4242 10the entity holding the license shall constitute a sale of the license. Violation of this paragraph 2 of 2
4343 11shall, after due notice and public hearing, be grounds for revocation of the license issued
4444 12hereunder.
4545 13 If a license granted pursuant to this act is canceled, revoked or no longer in use, it shall be
4646 14returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to
4747 15the licensing authority of the City of Northampton, which may then grant the license to a new
4848 16applicant at the same location or new location in the city under the same conditions as specified
4949 17in this act. The applicant for a license returned to the licensing authority shall file with the
5050 18licensing authority a letter from the departure of revenue and a letter from the department of
5151 19unemployment assistance indicating that the license is in good standing with those departments
5252 20and that all applicable taxes, fees and contributions have been paid.
5353 21 SECTION 2. This act shall take effect upon its passage.
