31 | 31 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
32 | 32 | | of the same, as follows: |
---|
33 | 33 | | 1 SECTION 1. Notwithstanding section 17 of chapter 138 of the General Laws or any other |
---|
34 | 34 | | 2general or special law to the contrary, the licensing authority of the City of Northampton may |
---|
35 | 35 | | 3grant seven (7) additional licenses for the sale of all alcoholic beverages to be drunk on the |
---|
36 | 36 | | 4premises, under section 12 of said chapter 138, to seven entities deemed appropriate by the |
---|
37 | 37 | | 5licensing authority of the City of Northampton. The licenses shall be subject to all of said chapter |
---|
38 | 38 | | 6138, except said section 17. |
---|
39 | 39 | | 7 The licensing authority shall not approve the transfer of a license granted pursuant to this |
---|
40 | 40 | | 8act nor shall a license be marketed for sale, sold or pledged to any other entity or location. For |
---|
41 | 41 | | 9purposes of this paragraph, a conveyance or transfer of more than forty-nine percent interest in |
---|
42 | 42 | | 10the entity holding the license shall constitute a sale of the license. Violation of this paragraph 2 of 2 |
---|
43 | 43 | | 11shall, after due notice and public hearing, be grounds for revocation of the license issued |
---|
44 | 44 | | 12hereunder. |
---|
45 | 45 | | 13 If a license granted pursuant to this act is canceled, revoked or no longer in use, it shall be |
---|
46 | 46 | | 14returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to |
---|
47 | 47 | | 15the licensing authority of the City of Northampton, which may then grant the license to a new |
---|
48 | 48 | | 16applicant at the same location or new location in the city under the same conditions as specified |
---|
49 | 49 | | 17in this act. The applicant for a license returned to the licensing authority shall file with the |
---|
50 | 50 | | 18licensing authority a letter from the departure of revenue and a letter from the department of |
---|
51 | 51 | | 19unemployment assistance indicating that the license is in good standing with those departments |
---|
52 | 52 | | 20and that all applicable taxes, fees and contributions have been paid. |
---|
53 | 53 | | 21 SECTION 2. This act shall take effect upon its passage. |
