23 | 23 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
24 | 24 | | of the same, as follows: |
---|
25 | 25 | | 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the |
---|
26 | 26 | | 2licensing authority of the town of Mansfield may grant one additional license for the sale of all |
---|
27 | 27 | | 3alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to |
---|
28 | 28 | | 4Jay Amruta Corporation, d/b/a Mansfield Liquor Market, located at the Reservoir Landing, 30 |
---|
29 | 29 | | 5Reservoir Street, in the town. The license granted pursuant to this act shall be subject to all of |
---|
30 | 30 | | 6said chapter 138 except said section 17. |
---|
31 | 31 | | 7 (b) The licensing authority shall not approve the transfer of a license granted pursuant to |
---|
32 | 32 | | 8this act to any other location, but it may grant the license to a new applicant at the same location |
---|
33 | 33 | | 9if the applicant files with the licensing authority a letter from the department of revenue and a |
---|
34 | 34 | | 10letter from the department of unemployment assistance indicating the license is in good standing |
---|
35 | 35 | | 11with those departments and that all applicable taxes, fees, and contributions have been paid. |
---|
36 | 36 | | 12 (c) If the licensee terminates or fails to renew the license granted under this act, or if such |
---|
37 | 37 | | 13license is revoked or no longer in use, it shall be returned physically, with all of the legal rights 2 of 2 |
---|
38 | 38 | | 14and privileges pertaining thereto, to the licensing authority, which may, within 3 years after such |
---|
39 | 39 | | 15return, then grant the license to a new applicant at the same location and under the same |
---|
40 | 40 | | 16conditions as specified in this act, otherwise such license shall dissolve. |
---|
41 | 41 | | 17 (d) The license granted under this act shall be issued within 2 years after the effective |
---|
42 | 42 | | 18date of this act; provided, however, that if the license is originally granted within that time |
---|
43 | 43 | | 19period, it may be granted to a new applicant under subsections (b), and (c) thereafter. |
---|
44 | 44 | | 20 SECTION 2: This act shall take effect upon its passage. |
---|
