2525 An Act regulating medical imaging and radiation therapy.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Section 5L of chapter 111 of the General Laws, as appearing in the 2020
2929 2Official Edition, is hereby amended by striking out the fifth paragraph and inserting in place
3030 3thereof the following paragraph:-
3131 4 The department shall establish the requirements for registration, collect registration fees,
3232 5establish ethical standards including, sonography usage outside of hospitals and medical facilities
3333 6on pregnant persons, require and establish continuing educational requirements, evaluate the
3434 7qualifications of the applicants, investigate complaints, supervise examinations and grant
3535 8licenses to those who pass the examination and who are determined to be qualified radiologic
3636 9technologists. No person shall perform the duties of a radiologic technologist without such
3737 10license however, the department may grant a temporary waiver for 3 months upon a finding that
3838 11the public convenience and necessity require such a waiver. The fee for such license and renewal
3939 12shall be determined annually by the commissioner of administration under the provisions of
4040 13section 3B of chapter 7. 2 of 2
4141 14 SECTION 2. Chapter 112 of the General Law, as appearing in the 2020 Official Edition,
4242 15is hereby amended by adding the following section:-
4343 16 Section 290. (a) For the purposes of this section the following words shall, unless the
4444 17context clearly requires otherwise, have the following meanings:
4545 18 “Commissioner'', the commissioner of public health.
4646 19 “Department'', the department of public health.
4747 20 “Medical imaging”, any procedure intended for use in the diagnosis or visualization of a
4848 21pregnancy or other medical conditions using sonography or ultrasound technologies.
4949 22 “Sonographer”, a person licensed to perform a comprehensive set of diagnostic
5050 23sonography procedures using an ultrasound to create medical images.
5151 24 (b) The department shall establish the requirements for registration, collect registration
5252 25fees, establish ethical standards, require and establish continuing educational requirements,
5353 26evaluate the qualifications of the applicants, investigate complaints, supervise examinations and
5454 27grant licenses to those who pass the examination and who are determined to be qualified
5555 28sonographer. No person shall perform the duties of medical imaging on humans using
5656 29sonography or ultrasound technology without such license.
5757 30 (c) The fee for a sonographer license and renewal shall be determined annually by the
5858 31commissioner.
5959 32 (d) The department of shall promulgate rules or regulations necessary to carry out this
6060 33section.
