26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |
---|
28 | 28 | | 1 SECTION 1. Section 5L of chapter 111 of the General Laws, as appearing in the 2020 |
---|
29 | 29 | | 2Official Edition, is hereby amended by striking out the fifth paragraph and inserting in place |
---|
30 | 30 | | 3thereof the following paragraph:- |
---|
31 | 31 | | 4 The department shall establish the requirements for registration, collect registration fees, |
---|
32 | 32 | | 5establish ethical standards including, sonography usage outside of hospitals and medical facilities |
---|
33 | 33 | | 6on pregnant persons, require and establish continuing educational requirements, evaluate the |
---|
34 | 34 | | 7qualifications of the applicants, investigate complaints, supervise examinations and grant |
---|
35 | 35 | | 8licenses to those who pass the examination and who are determined to be qualified radiologic |
---|
36 | 36 | | 9technologists. No person shall perform the duties of a radiologic technologist without such |
---|
37 | 37 | | 10license however, the department may grant a temporary waiver for 3 months upon a finding that |
---|
38 | 38 | | 11the public convenience and necessity require such a waiver. The fee for such license and renewal |
---|
39 | 39 | | 12shall be determined annually by the commissioner of administration under the provisions of |
---|
40 | 40 | | 13section 3B of chapter 7. 2 of 2 |
---|
41 | 41 | | 14 SECTION 2. Chapter 112 of the General Law, as appearing in the 2020 Official Edition, |
---|
42 | 42 | | 15is hereby amended by adding the following section:- |
---|
43 | 43 | | 16 Section 290. (a) For the purposes of this section the following words shall, unless the |
---|
44 | 44 | | 17context clearly requires otherwise, have the following meanings: |
---|
45 | 45 | | 18 “Commissioner'', the commissioner of public health. |
---|
46 | 46 | | 19 “Department'', the department of public health. |
---|
47 | 47 | | 20 “Medical imaging”, any procedure intended for use in the diagnosis or visualization of a |
---|
48 | 48 | | 21pregnancy or other medical conditions using sonography or ultrasound technologies. |
---|
49 | 49 | | 22 “Sonographer”, a person licensed to perform a comprehensive set of diagnostic |
---|
50 | 50 | | 23sonography procedures using an ultrasound to create medical images. |
---|
51 | 51 | | 24 (b) The department shall establish the requirements for registration, collect registration |
---|
52 | 52 | | 25fees, establish ethical standards, require and establish continuing educational requirements, |
---|
53 | 53 | | 26evaluate the qualifications of the applicants, investigate complaints, supervise examinations and |
---|
54 | 54 | | 27grant licenses to those who pass the examination and who are determined to be qualified |
---|
55 | 55 | | 28sonographer. No person shall perform the duties of medical imaging on humans using |
---|
56 | 56 | | 29sonography or ultrasound technology without such license. |
---|
57 | 57 | | 30 (c) The fee for a sonographer license and renewal shall be determined annually by the |
---|
58 | 58 | | 31commissioner. |
---|
59 | 59 | | 32 (d) The department of shall promulgate rules or regulations necessary to carry out this |
---|
60 | 60 | | 33section. |
