An Act regulating medical imaging and radiation therapy.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. Section 5L of chapter 111 of the General Laws, as appearing in the 2020 
2Official Edition, is hereby amended by striking out the fifth paragraph and inserting in place 
3thereof the following paragraph:-
4 The department shall establish the requirements for registration, collect registration fees, 
5establish ethical standards 	including, sonography usage outside of hospitals and medical facilities 
6on pregnant persons, require and establish continuing educational requirements, evaluate the 
7qualifications of the applicants, investigate complaints, supervise examinations and grant 
8licenses to those who pass the examination and who are determined to be qualified radiologic 
9technologists. No person shall perform the duties of a radiologic technologist without such 
10license however, the department may grant a temporary waiver for 3 months upon a finding that 
11the public convenience and necessity require such a waiver. The fee for such license and renewal 
12shall be determined annually by the commissioner of administration under the provisions of 
13section 3B of chapter 7. 2 of 2
14 SECTION 2. Chapter 112 of the General Law, as appearing in the 2020 Official Edition, 
15is hereby amended by adding the following section:-
16 Section 290. (a) For the purposes of this section the following words shall, unless the 
17context clearly requires otherwise, have the following meanings:
18 “Commissioner'', the commissioner of public health.
19 “Department'', the department of public health.
20 “Medical imaging”, any procedure intended for use in the diagnosis or visualization of a 
21pregnancy or other medical conditions using sonography or ultrasound technologies.
22 “Sonographer”, a person licensed to perform a comprehensive set of diagnostic 
23sonography procedures using an ultrasound to create medical images.
24 (b) The department shall establish the requirements for registration, collect registration 
25fees, establish ethical standards, require and establish continuing educational requirements, 
26evaluate the qualifications of the applicants, investigate complaints, supervise examinations and 
27grant licenses to those who pass the examination and who are determined to be qualified 
28sonographer. No person shall perform the duties of medical imaging on humans using 
29sonography or ultrasound technology without such license.
30 (c) The fee for a sonographer license and renewal shall be determined annually by the 
31commissioner.
32 (d) The department of shall promulgate rules or regulations necessary to carry out this 
33section.
