3030 An Act authorizing the town of Nantucket to convey a certain parcel of land situated in the town
3131 of Nantucket held for park purposes to the Nantucket Conservation Foundation Inc. for open
3232 space, recreational, and conservation purposes.
3333 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3434 of the same, as follows:
3535 1 Section 1. Pursuant to Article 97 of the Amendments to the Constitution of the
3636 2Commonwealth of Massachusetts and notwithstanding the provisions of any general or special
3737 3law to the contrary, the Town of Nantucket may transfer, sell, convey or otherwise dispose of all
3838 4or a portion of a certain parcel of land situated in the Town of Nantucket to the Nantucket
3939 5Conservation Foundation, Inc. for open space, recreational, and conservation purposes, to be on
4040 6any terms and conditions the Select Board deem appropriate, which may include the reservation
4141 7of any easements and restrictions in regard to the property, described as follows:
4242 8 • Tax Assessor’s Map 45, Parcel 9, 50 Altar Rock Road;
4343 9 Any such disposition shall be on such terms and conditions as the Select Board deem
4444 10appropriate, which may include the reservation of restrictions and easements and acceptance of 2 of 2
4545 11the conveyance of certain land from the Nantucket Conservation Foundation, Inc. to satisfy the
4646 12Executive Office of Energy and Environmental Affairs “no net loss policy” as determined by the
4747 13Select Board, all as shown on a map entitled “2022 Annual Town Meeting Warrant Articles 93 +
4848 1494 Real Estate Conveyance: 50 Altar Rock Road (to Nantucket Conservation Foundation, Inc.)”
4949 15dated January 2022 and filed with the Office of the Town Clerk.
5050 16 Section 2. This act shall take effect upon its passage.
