22 | 22 | | the premises in the town of Chatham. |

23 | 23 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
24 | 24 | | of the same, as follows: |
---|
25 | 25 | | 1 SECTION 1. (a) Notwithstanding sections 17 and 17A of chapter 138 of the General |
---|
26 | 26 | | 2Laws, the licensing authority of the town of Chatham may convert 1 seasonal license for the sale |
---|
27 | 27 | | 3of all alcoholic beverages to be drunk on the premises, under section 12 of said chapter 138, |
---|
28 | 28 | | 4currently issued to Pate’s Restaurant located at 1260 Main Street to an annual license for the sale |
---|
29 | 29 | | 5of all alcoholic beverages to be drunk on the premises under said section 12 of said chapter 138 |
---|
30 | 30 | | 6to Pate’s Restaurant for use at 1260 Main Street in the town. The license converted under this |
---|
31 | 31 | | 7section shall be subject to all provisions of said chapter 138, except said sections 17 and 17A. |
---|
32 | 32 | | 8 (b) A license converted under this section shall only be exercised in the dining room of a |
---|
33 | 33 | | 9common victualler and such other public rooms or areas as may be deemed reasonable and |
---|
34 | 34 | | 10appropriate by the licensing authority as certified in writing. |
---|
35 | 35 | | 11 (c) The licensing authority shall not approve the transfer of the license converted |
---|
36 | 36 | | 12pursuant to this section to any other location, but it may grant the license to a new applicant at |
---|
37 | 37 | | 13the same location if the applicant files with the licensing authority a letter from the department of 2 of 2 |
---|
38 | 38 | | 14revenue and a letter from the department of unemployment assistance indicating that the license |
---|
39 | 39 | | 15if in good standing with those departments and that all applicable taxes, fees, and contributions |
---|
40 | 40 | | 16have been paid. |
---|
41 | 41 | | 17 (d) If the license converted under this act is cancelled, revoked or no longer in use at the |
---|
42 | 42 | | 18location of original issuance, it shall be returned physically, with all legal rights, privileges and |
---|
43 | 43 | | 19restrictions pertaining thereto, to the licensing authority which may then, within 3 years grant the |
---|
44 | 44 | | 20license to a new applicant at the same location under the same conditions as specified in this act, |
---|
45 | 45 | | 21otherwise such license shall dissolve. |
---|
46 | 46 | | 22 SECTION 2. This act shall take effect upon its passage. |
