28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
29 | 29 | | of the same, as follows: |
---|
30 | 30 | | 1 SECTION 1. Notwithstanding the provisions of Section 1 of Chapter 41 of the General |
---|
31 | 31 | | 2Laws or any other general or special law to the contrary, there shall be a treasurer-collector of the |
---|
32 | 32 | | 3town of Sherborn. The treasurer-collector shall be appointed by the select board for a term not to |
---|
33 | 33 | | 4exceed three years. The select board may establish an employment contract with the treasurer- |
---|
34 | 34 | | 5collector for salary, fringe benefits and other conditions of employment. The treasurer-collector |
---|
35 | 35 | | 6shall have all the powers, perform the duties and be subject to the liabilities and penalties now or |
---|
36 | 36 | | 7hereafter conferred and imposed by law on town treasurers and town collectors of taxes. |
---|
37 | 37 | | 8 SECTION 2. Upon the effective date of this act, the offices of treasurer and collector |
---|
38 | 38 | | 9shall be abolished and the term of the incumbents of such offices terminated; provided, however, |
---|
39 | 39 | | 10that notwithstanding section 1, the incumbent appointed town treasurer shall be the first |
---|
40 | 40 | | 11appointee to the new combined position of treasurer-collector and shall hold the office and |
---|
41 | 41 | | 12perform the duties thereof until the expiration of the term for which the town treasurer was 2 of 2 |
---|
42 | 42 | | 13appointed, unless the incumbent sooner vacates that office. Thereafter, appointments to the |
---|
43 | 43 | | 14position of treasurer-collector shall be made pursuant to section 1. |
---|
44 | 44 | | 15 SECTION 3. No contracts or liabilities in force on the effective date of this act shall be |
---|
45 | 45 | | 16affected by the abolition of the elected offices of town treasurer or town collector or the creation |
---|
46 | 46 | | 17of the combined appointed office and the appointed treasurer-collector shall, in all respects, be |
---|
47 | 47 | | 18the lawful successor of the offices so abolished or consolidated. All records, property and |
---|
48 | 48 | | 19equipment of the offices of the elected town treasurer and elected town collector shall be |
---|
49 | 49 | | 20assigned to the office of the appointed treasurer-coIlector. |
---|
50 | 50 | | 21 SECTION 4. This act shall take effect upon its passage. |
