29 | 29 | | 2 Chapter 94 of the General Laws, as appearing in the 2020 Official Edition, is hereby |
---|
30 | 30 | | 3amended by adding the following section:- |

31 | 31 | | 4 Section 330. Mobile Food Establishment Licensure |
---|
32 | 32 | | 5 For the purposes of this section, the term “mobile food establishment” shall mean a |
---|
33 | 33 | | 6vehicle-mounted, self-contained food service operation, such as a food truck, designed to be |
---|
34 | 34 | | 7readily moveable and used to store, prepare, display, serve, or sell food. The term “department” |
---|
35 | 35 | | 8shall mean the Food Protection Program. |
---|
36 | 36 | | 9 The Food Protection Program shall promulgate rules and regulations establishing legal |
---|
37 | 37 | | 10standards and responsibilities for mobile food establishments. The department shall be the sole |
---|
38 | 38 | | 11authority empowered to issue licenses for the operation of mobile food establishments. Such |
---|
39 | 39 | | 12rules and regulations shall include, but not be limited to, the requirement that mobile food 2 of 2 |

40 | 40 | | 13establishments pass an inspection conducted by the fire department in the municipality in which |
---|
41 | 41 | | 14the mobile food establishment has its mailing address. Towns and municipalities may assess a |
---|
42 | 42 | | 15fee on mobile food establishments operating in their jurisdiction. |
