An Act relative to food truck licensure.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1.
2 Chapter 94 of the General Laws, as appearing in the 2020 Official Edition, is hereby 
3amended by adding the following section:- 
4 Section 330. Mobile Food Establishment Licensure
5 For the purposes of this section, the term “mobile food establishment” shall mean a 
6vehicle-mounted, self-contained food service operation, such as a food truck, designed to be 
7readily moveable and used to store, prepare, display, serve, or sell food. The term “department” 
8shall mean the Food Protection Program. 
9 The Food Protection Program shall promulgate rules and regulations establishing legal 
10standards and responsibilities for mobile food establishments. The department shall be the sole 
11authority empowered to issue licenses for the operation of mobile food establishments. Such 
12rules and regulations shall include, but not be limited 	to, the requirement that mobile food  2 of 2
13establishments pass an inspection conducted by the fire department in the municipality in which 
14the mobile food establishment has its mailing address. Towns and municipalities may assess a 
15fee on mobile food establishments operating in their jurisdiction.
