2929 An Act to improve emergency service access in Cummington.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Notwithstanding any general or special law to the contrary, the department
3333 2of conservation and recreation shall work in coordination with the town of Cummington fire
3434 3department to create and maintain a new utility task vehicle, also known as a utility terrain
3535 4vehicle, (UTV) trail from Hendricks road along East Mountain road to the beach in the Gilbert
3636 5A. Bliss State Forest for the purpose of allowing emergency services access by the Cummington
3737 6fire department to the area and the beach.
3838 7 SECTION 2. The land to be used for the emergency services access in section 1 is owned
3939 8by the department of conservation and recreation and such use or access may be licensed by the
4040 9department to the town of Cummington for a renewable term of 5-years. Such license shall not
4141 10be a disposition of an interest in land of the commonwealth and shall not be subject to Article 97
4242 11of the Amendments to the Massachusetts Constitution or section 5A of chapter 3 of the General
4343 12Laws.
