30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
31 | 31 | | of the same, as follows: |

32 | 32 | | 1 SECTION 1. Notwithstanding any general or special law to the contrary, the department |
---|
33 | 33 | | 2of conservation and recreation shall work in coordination with the town of Cummington fire |
---|
34 | 34 | | 3department to create and maintain a new utility task vehicle, also known as a utility terrain |
---|
35 | 35 | | 4vehicle, (UTV) trail from Hendricks road along East Mountain road to the beach in the Gilbert |
---|
36 | 36 | | 5A. Bliss State Forest for the purpose of allowing emergency services access by the Cummington |
---|
37 | 37 | | 6fire department to the area and the beach. |

38 | 38 | | 7 SECTION 2. The land to be used for the emergency services access in section 1 is owned |

39 | 39 | | 8by the department of conservation and recreation and such use or access may be licensed by the |

40 | 40 | | 9department to the town of Cummington for a renewable term of 5-years. Such license shall not |

41 | 41 | | 10be a disposition of an interest in land of the commonwealth and shall not be subject to Article 97 |

42 | 42 | | 11of the Amendments to the Massachusetts Constitution or section 5A of chapter 3 of the General |
