2626 An Act relative to town meeting vacancy in the town of Burlington.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Notwithstanding any general or special law to the contrary, Chapter 686 of the Acts of
3030 21970, is amended by replacing Section 9 in its entirety as follows: SECTION 9. (a) The office of
3131 3a Town Meeting Member shall become vacant upon their death, resignation or removal from
3232 4office in any manner authorized by law. (b) A vacancy in the town meeting membership shall be
3333 5filled for the remainder of the unexpired term, if any, at the next regular town election if
3434 6resignation or removal from office in any manner authorized by law. (c) A vacancy in the town
3535 7meeting membership shall be filled for the remainder of the unexpired term, if any, at the next
3636 8regular town election. When a vacancy in the Town Meeting membership shall occur and no
3737 9Town election is to be held within sixty (60) days, the Moderator shall direct the Town Clerk to
3838 10post notice of any such vacancy and a request for candidates. Said notice shall be published by
3939 11the Town Clerk not less than fourteen (14) days prior to the next scheduled Town Meeting: (i) In
4040 12a newspaper; 2 of 2
4141 13 (ii) on the bulletin board outside the Town Clerk’s office; and
4242 14 (iii) on the Town’s website.
4343 15 All candidate information received by the Clerk shall be forwarded to the remaining
4444 16members prior to the vote; said vote to take place at the next scheduled Town Meeting. The
4545 17vacancy shall be filled by a majority vote of the remaining precinct members in attendance at the
4646 18next scheduled Town Meeting.
