Gordon (by vote of the town) relative to town meeting vacancies in the town of Burlington. Election Laws. [Local Approval Received.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to town meeting vacancy in the town of Burlington. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Notwithstanding any general or special law to the contrary, Chapter 686 of the Acts of 21970, is amended by replacing Section 9 in its entirety as follows: SECTION 9. (a) The office of 3a Town Meeting Member shall become vacant upon their death, resignation or removal from 4office in any manner authorized by law. (b) A vacancy in the town meeting membership shall be 5filled for the remainder of the unexpired term, if any, at the next regular town election if 6resignation or removal from office in any manner authorized by law. (c) A vacancy in the town 7meeting membership shall be filled for the remainder of the unexpired term, if any, at the next 8regular town election. When a vacancy in the Town Meeting membership shall occur and no 9Town election is to be held within sixty (60) days, the Moderator shall direct the Town Clerk to 10post notice of any such vacancy and a request for candidates. Said notice shall be published by 11the Town Clerk not less than fourteen (14) days prior to the next scheduled Town Meeting: (i) In 12a newspaper; 2 of 2 13 (ii) on the bulletin board outside the Town Clerk’s office; and 14 (iii) on the Town’s website. 15 All candidate information received by the Clerk shall be forwarded to the remaining 16members prior to the vote; said vote to take place at the next scheduled Town Meeting. The 17vacancy shall be filled by a majority vote of the remaining precinct members in attendance at the 18next scheduled Town Meeting.
