30 | 30 | | Whereas, The deferred operation of this act would tend to defeat its purpose, which is to |
---|
31 | 31 | | provide forthwith a conveyance of land in the town of Stoneham, therefore it is hereby declared |
---|
32 | 32 | | to be an emergency law, necessary for the immediate preservation of the public convenience. |
---|
33 | 33 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
34 | 34 | | of the same, as follows: |
---|
35 | 35 | | 1 SECTION 1. Notwithstanding section 7E of chapter 81 of the General Laws, or any other |
---|
36 | 36 | | 2general or special law to the contrary, the Secretary of the Massachusetts Department of |
---|
37 | 37 | | 3Transportation may, on behalf of the administrator of the division of highways, convey to |
---|
38 | 38 | | 4Wakefield Investments, Inc. a certain parcel of land in the town of Stoneham owned by the |
---|
39 | 39 | | 5Massachusetts Department of Transportation (MassDOT) and taken for highway purposes in |
---|
40 | 40 | | 61958 under Highway Layout 4724, for the purposes of reconstructing an off-ramp from the |
---|
41 | 41 | | 7Interstate 93 northbound to Montvale Avenue and Maple Street. |
---|
42 | 42 | | 8 SECTION 2. The parcel of land to be conveyed pursuant to section 1 is described as |
---|
43 | 43 | | 9follows: the property situated in the town of Stoneham, herein known as a portion of Parcel 2-31, 2 of 2 |
---|
44 | 44 | | 10which is landlocked to the abutting property owner at 100 Maple Street, and described in a 1958 |
---|
45 | 45 | | 11Order of Taking, under Layout 4724, dated September 23, 1958, and recorded in the South |
---|
46 | 46 | | 12Middlesex Registry of Deeds in Book 9244, Page 114, containing 12,500 square feet of land, |
---|
47 | 47 | | 13more or less. |

48 | 48 | | 14 SECTION 3. The consideration for the conveyance authorized in this act shall be the full |

49 | 49 | | 15and fair market value of the parcel as determined by the Secretary of Massachusetts Department |
---|
50 | 50 | | 16of Transportation, and as agreed to by the abutting property owner, Wakefield Investments, Inc. |
---|
51 | 51 | | 17 SECTION 4. Notwithstanding any general or special law to the contrary, Wakefield |
---|
52 | 52 | | 18Investments, Inc., of Wakefield Massachusetts, shall be responsible for all of its costs and |
---|
53 | 53 | | 19expenses related to this transaction, including, but not limited to costs associated with any |
---|
54 | 54 | | 20engineering, surveys, appraisals and deed preparation related to the conveyance authorized in |
---|
55 | 55 | | 21this act as such costs may be determined by the Secretary of the Massachusetts Department of |
---|
56 | 56 | | 22Transportation. |
