2828 An Act authorizing the Massachusetts Department of Transportation to convey a certain parcel
2929 of land in the town of Stoneham.
3030 Whereas, The deferred operation of this act would tend to defeat its purpose, which is to
3131 provide forthwith a conveyance of land in the town of Stoneham, therefore it is hereby declared
3232 to be an emergency law, necessary for the immediate preservation of the public convenience.
3333 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3434 of the same, as follows:
3535 1 SECTION 1. Notwithstanding section 7E of chapter 81 of the General Laws, or any other
3636 2general or special law to the contrary, the Secretary of the Massachusetts Department of
3737 3Transportation may, on behalf of the administrator of the division of highways, convey to
3838 4Wakefield Investments, Inc. a certain parcel of land in the town of Stoneham owned by the
3939 5Massachusetts Department of Transportation (MassDOT) and taken for highway purposes in
4040 61958 under Highway Layout 4724, for the purposes of reconstructing an off-ramp from the
4141 7Interstate 93 northbound to Montvale Avenue and Maple Street.
4242 8 SECTION 2. The parcel of land to be conveyed pursuant to section 1 is described as
4343 9follows: the property situated in the town of Stoneham, herein known as a portion of Parcel 2-31, 2 of 2
4444 10which is landlocked to the abutting property owner at 100 Maple Street, and described in a 1958
4545 11Order of Taking, under Layout 4724, dated September 23, 1958, and recorded in the South
4646 12Middlesex Registry of Deeds in Book 9244, Page 114, containing 12,500 square feet of land,
4747 13more or less.
4848 14 SECTION 3. The consideration for the conveyance authorized in this act shall be the full
4949 15and fair market value of the parcel as determined by the Secretary of Massachusetts Department
5050 16of Transportation, and as agreed to by the abutting property owner, Wakefield Investments, Inc.
5151 17 SECTION 4. Notwithstanding any general or special law to the contrary, Wakefield
5252 18Investments, Inc., of Wakefield Massachusetts, shall be responsible for all of its costs and
5353 19expenses related to this transaction, including, but not limited to costs associated with any
5454 20engineering, surveys, appraisals and deed preparation related to the conveyance authorized in
5555 21this act as such costs may be determined by the Secretary of the Massachusetts Department of
5656 22Transportation.
