Tarr (by vote of the town) relative to the appointment and election restrictions on finance committee and capital planning members in the town of Newbury. Municipalities and Regional Government. [Local Approval Received.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act amending the appointment and election restrictions on finance committee and capital planning members in the town of Newbury. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Section 5 of Chapter 460 of the Acts of 2008 is hereby amended by deleting 2said section and replacing it as follows: 3 A member of the select board, or of the regional school committee, or of the finance 4committee, during the term for which the member was elected or appointed, shall be ineligible 5either by election or appointment to hold any other town office. Any other person appointed by 6the select board or town administrator to a town office under this act or of any general or special 7law shall be eligible during the term of said office to appointment to any other town office, 8except that the town accountant shall not be eligible to hold the position of town treasurer or the 9position of town collector. The town administrator, subject to applicable General Laws relating 10thereto, may assume the duties of an office which he is authorized to fill by appointment. The 11first sentence hereof shall not apply to members of the Finance Committee who may be 2 of 2 12appointed to serve on the Capital Planning Committee but shall be ineligible either by election or 13appointment to hold any other town office. At no time shall more than two (2) members of the 14Finance Committee serve on the Capital Planning Committee. 15 SECTION 2. Chapter 460 of the Acts of 2008 is hereby amended by adding a new 16section 21 as follows: 17 SECTION 21: The term “town office” as used in this Act shall be considered any 18position either elected by registered voters of the town or appointed by the Newbury select 19board, town administrator, or other town board or committee who’s jurisdiction extends to the 20Newbury town limits and is not part of any greater regional or county organization or office. 21 SECTION 3. This act shall take effect upon its passage by the General Court.
