30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
31 | 31 | | of the same, as follows: |
---|
32 | 32 | | 1 SECTION 1. Section 5 of Chapter 460 of the Acts of 2008 is hereby amended by deleting |
---|
33 | 33 | | 2said section and replacing it as follows: |
---|
34 | 34 | | 3 A member of the select board, or of the regional school committee, or of the finance |
---|
35 | 35 | | 4committee, during the term for which the member was elected or appointed, shall be ineligible |
---|
36 | 36 | | 5either by election or appointment to hold any other town office. Any other person appointed by |
---|
37 | 37 | | 6the select board or town administrator to a town office under this act or of any general or special |
---|
38 | 38 | | 7law shall be eligible during the term of said office to appointment to any other town office, |
---|
39 | 39 | | 8except that the town accountant shall not be eligible to hold the position of town treasurer or the |
---|
40 | 40 | | 9position of town collector. The town administrator, subject to applicable General Laws relating |
---|
41 | 41 | | 10thereto, may assume the duties of an office which he is authorized to fill by appointment. The |
---|
42 | 42 | | 11first sentence hereof shall not apply to members of the Finance Committee who may be 2 of 2 |
---|
43 | 43 | | 12appointed to serve on the Capital Planning Committee but shall be ineligible either by election or |
---|
44 | 44 | | 13appointment to hold any other town office. At no time shall more than two (2) members of the |
---|
45 | 45 | | 14Finance Committee serve on the Capital Planning Committee. |

46 | 46 | | 15 SECTION 2. Chapter 460 of the Acts of 2008 is hereby amended by adding a new |
---|
47 | 47 | | 16section 21 as follows: |
---|
48 | 48 | | 17 SECTION 21: The term “town office” as used in this Act shall be considered any |
---|
49 | 49 | | 18position either elected by registered voters of the town or appointed by the Newbury select |
---|
50 | 50 | | 19board, town administrator, or other town board or committee who’s jurisdiction extends to the |
---|
51 | 51 | | 20Newbury town limits and is not part of any greater regional or county organization or office. |
---|
52 | 52 | | 21 SECTION 3. This act shall take effect upon its passage by the General Court. |
