No. 4769 By Representative Sabadosa of Northampton and Senator Mark, a joint petition (accompanied by bill, House, No. 4769) of Lindsay N. Sabadosa and Paul W. Mark (by vote of the town) that the town of Williamsburg be authorized to continue the employment of Glen Everett as a firefighter notwithstanding the mandatory retirement age in said town. Public Service. [Local Approval Received.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act authorizing the town of Williamsburg to continue employment of Glen Everett beyond the age of 65. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Notwithstanding any general or special law to the contrary, Glen Everett, a 2member of the fire department of the town of Williamsburg, who would be subject to mandatory 3retirement on the last day of the month in which he turns 65 years old, may continue to serve in 4such a position until 06/25/2029, or until the date of his retirement, or the date he is relieved of 5his duties by the Town, whichever occurs first; provided however, that no deductions shall be 6made from the regular compensation of Glen Everett pursuant to Chapter 32 of the General Laws 7for any service subsequent to him reaching the age of 65 in connection with his service to the 8Town for retirement purposes; provided further, that he is mentally and physically capable of 9performing the duties of his office; provided further, that the Town may at its own expense 10require that Glen Everett be examined by an impartial physician designated by the Town to 11determine such capability; and provided further, that Glen Everett shall, upon retirement, receive 2 of 2 12a superannuation retirement allowance equal to that which he would have been entitled had he 13retired at the age of 65. 14 (b) Notwithstanding section 1, Glen Everett shall be subject to chapter 6E of the General 15Laws and section 96B of chapter 41 of the General Laws for the duration of his employment 16pursuant to this act. 17 Section 2. This act shall take effect upon its passage.
