| 28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 29 | 29 | | of the same, as follows: |
|---|
| 30 | 30 | | 1 SECTION 1. |
|---|
| 31 | 31 | | 2 (a) Notwithstanding section 17 of chapter 138 of the General Laws or any other general |
|---|
| 32 | 32 | | 3or special, rule or regulation to the contrary, the licensing authority of the Town of Pembroke |
|---|
| 33 | 33 | | 4may grant one (1) additional license for the retail of alcohol beverages under section 15 of said |
|---|
| 34 | 34 | | 5chapter 138 to be exercised at and located at 295 Old Oak Street (Parcel ID: G15-36). A license |
|---|
| 35 | 35 | | 6granted under this section shall be subject to all of said chapter 138 except said section 17. |
|---|
| 36 | 36 | | 7 (b) Once issued, the licensing authority shall not approve the transfer of the license issued |
|---|
| 37 | 37 | | 8under subsection (a) to any other location, but it may grant the license to a new applicant at the |
|---|
| 38 | 38 | | 9same location if the applicant files with the authority a letter from the department of revenue and |
|---|
| 39 | 39 | | 10a letter from the department of unemployment assistance indicating the license is in good 2 of 2 |
|---|
| 40 | 40 | | 11standing with those departments and that all applicable taxes, fees and contributions have been |
|---|
| 41 | 41 | | 12paid. |
|---|
| 42 | 42 | | 13 (c) If the license granted under this section is cancelled, revoked or no longer in use, it |
|---|
| 43 | 43 | | 14shall be returned physically, with all of the legal rights, privileges and restrictions pertaining |
|---|
| 44 | 44 | | 15thereto, to the licensing authority, which may then grant the license to a new applicant at the |
|---|
| 45 | 45 | | 16same or a different location. |
