LaNatra (by vote of the town) that the town of Pembroke be authorized to issue one additional license for the sale of all alcohol beverages not to be drunk on the premises in said town. Consumer Protection and Professional Licensure. [Local Approval Received.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act authorizing the Town of Pembroke to issue one additional license. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. 2 (a) Notwithstanding section 17 of chapter 138 of the General Laws or any other general 3or special, rule or regulation to the contrary, the licensing authority of the Town of Pembroke 4may grant one (1) additional license for the retail of alcohol beverages under section 15 of said 5chapter 138 to be exercised at and located at 295 Old Oak Street (Parcel ID: G15-36). A license 6granted under this section shall be subject to all of said chapter 138 except said section 17. 7 (b) Once issued, the licensing authority shall not approve the transfer of the license issued 8under subsection (a) to any other location, but it may grant the license to a new applicant at the 9same location if the applicant files with the authority a letter from the department of revenue and 10a letter from the department of unemployment assistance indicating the license is in good 2 of 2 11standing with those departments and that all applicable taxes, fees and contributions have been 12paid. 13 (c) If the license granted under this section is cancelled, revoked or no longer in use, it 14shall be returned physically, with all of the legal rights, privileges and restrictions pertaining 15thereto, to the licensing authority, which may then grant the license to a new applicant at the 16same or a different location.
