No. 4866 The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act authorizing the town of Wrentham to grant an additional 7 licenses for the sale of all alcoholic beverages to be drunk on the premises. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the 2licensing authority of the town of Wrentham may grant 7 additional licenses for the sale of all 3alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138 to 4establishments located within the 3 development zones as described in subsection (b) upon 5approval of and under conditions set by the licensing authority of the town of Wrentham. A 6license granted under this act shall be clearly marked on its face either “Village Zone A”, 7“Village Zone B”, or “Stonewall Blvd Development”, as applicable, and shall be subject to all of 8said chapter 138 except section 17. 9 (b) The licensing authority shall restrict the 7 licenses authorized in this act as follows: 10 (1) Two licenses shall be issued to establishments located with the town’s Village Zone A 11Planned Development district shown on a map entitled “Future Development Map: Village Zone 12A & B” as dated on September 21, 2023, a copy of which is on file in the office of the town 13clerk; 2 of 3 14 (2) Three licenses shall be issued to establishments located within the town’s Village 15Zone B district shown on a map entitled “Future Development Map: Village Zone A & B” as 16dated on September 21, 2023, a copy of which is on file in the office of the town clerk; and 17 (3) Two licenses shall be issued to establishments located within the town’s C-1 Planned 18Development district shown on a map entitled “Future Development Map: Stonewall Blvd 19Development” as dated on September 21, 2023, a copy of which is on file in the office of the 20town clerk. 21 (c) A license granted pursuant to this section shall only be exercised in the dining room of 22a common victualler and in such other public rooms or areas as may be deemed reasonable and 23appropriate by the licensing authority as certified in writing. 24 (d) The licensing authority shall not approve the transfer of a license granted pursuant to 25this act to a location outside of the initial zoned areas as described in paragraph (1), (2), or (3) of 26subsection (b), but it may grant a license to new applicant within such initial zoned area if the 27applicant files with the licensing authority a letter from the department of revenue and a letter 28from the department of unemployment assistance indicating that the license is in good standing 29with those departments and that all applicable taxes, fees and contributions have been paid. 30 (e) If a licensee terminates or fails to renew a license granted under this act or any such 31license granted under this act is cancelled, revoked or no longer in use, the license shall be 32returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to 33the licensing authority and the licensing authority may then grant the license to a new applicant 34under the same conditions specified in this act. 3 of 3 35 (f) All licenses granted under this act shall be issued within 3 years after the effective 36date of this act; provided, however, that a license originally granted within that time period may 37be granted to a new applicant under subsections (d) and (e) thereafter. 38 SECTION 2. This act shall take effect upon its passage.
