| 23 | 23 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 24 | 24 | | of the same, as follows: |
|---|
| 25 | 25 | | 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the |
|---|
| 26 | 26 | | 2licensing authority of the city of Revere may grant 2 additional licenses for the sale of all |
|---|
| 27 | 27 | | 3alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to |
|---|
| 28 | 28 | | 4establishments located within the Suffolk Downs Overlay District, as defined in subsection (b), |
|---|
| 29 | 29 | | 5upon approval of and under conditions set by the licensing authority of the city of Revere. A |
|---|
| 30 | 30 | | 6license granted under this act shall be clearly marked on its face “Suffolk Downs Overlay |
|---|
| 31 | 31 | | 7District” and shall be subject to all of said chapter 138 except said section 17. |
|---|
| 32 | 32 | | 8 (b) The licensing authority of the city of Revere shall restrict the 2 licenses granted |
|---|
| 33 | 33 | | 9pursuant to this act to establishments within the “Suffolk Downs Overlay District” as shown and |
|---|
| 34 | 34 | | 10defined in the document entitled “An Ordinance Amending the Zoning Map and Zoning |
|---|
| 35 | 35 | | 11Ordinances of the City of Revere” as dated March 19, 2018 and approved on March 27, 2018, a |
|---|
| 36 | 36 | | 12copy of which is on file in the office of the city clerk of the city of Revere. 2 of 2 |

| 37 | 37 | | 13 (c) The licensing authority of the city of Revere shall not approve the transfer of a license |
|---|
| 38 | 38 | | 14granted pursuant to this act to a location outside of the city’s Suffolk Downs Overlay District as |
|---|
| 39 | 39 | | 15described in subsection (b), but it may grant a license to a new applicant within the Suffolk |
|---|
| 40 | 40 | | 16Downs Overlay District if the applicant files with the licensing authority a letter from the |
|---|
| 41 | 41 | | 17department of revenue and a letter from the department of unemployment assistance indicating |
|---|
| 42 | 42 | | 18that the license is in good standing with those departments and that all applicable taxes, fees and |
|---|
| 43 | 43 | | 19contributions have been paid. |
|---|
| 44 | 44 | | 20 (d) If a licensee terminates or fails to renew a license granted under this act or any such |
|---|
| 45 | 45 | | 21license is cancelled, revoked or no longer in use, it shall be returned physically, with all of the |
|---|
| 46 | 46 | | 22legal rights, privileges, and restrictions pertaining thereto, to the licensing authority which may, |
|---|
| 47 | 47 | | 23within 2 years of such return, then grant the license to a new applicant within the city’s Suffolk |
|---|
| 48 | 48 | | 24Downs Overlay District under the same conditions as specified in this act, otherwise such license |
|---|
| 49 | 49 | | 25shall dissolve. |
|---|
| 50 | 50 | | 26 (e) A license granted pursuant to this act shall be issued within 1 year after the effective |
|---|
| 51 | 51 | | 27date of this act; provided, however, that if a license is originally granted within that time period, |
|---|
| 52 | 52 | | 28such license may be granted to a new applicant pursuant to subsections (c) and (d) thereafter. |
|---|
| 53 | 53 | | 29 SECTION 2. This act shall take effect upon its passage. |
