2121 An Act authorizing the city of Revere to grant two additional licenses for the sale of all alcoholic
2222 beverages not to be drunk on the premises.
2323 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2424 of the same, as follows:
2525 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2626 2licensing authority of the city of Revere may grant 2 additional licenses for the sale of all
2727 3alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138 to
2828 4establishments located within the Suffolk Downs Overlay District, as defined in subsection (b),
2929 5upon approval of and under conditions set by the licensing authority of the city of Revere. A
3030 6license granted under this act shall be clearly marked on its face “Suffolk Downs Overlay
3131 7District” and shall be subject to all of said chapter 138 except said section 17.
3232 8 (b) The licensing authority of the city of Revere shall restrict the 2 licenses granted
3333 9pursuant to this act to establishments within the “Suffolk Downs Overlay District” as shown and
3434 10defined in the document entitled “An Ordinance Amending the Zoning Map and Zoning
3535 11Ordinances of the City of Revere” as dated March 19, 2018 and approved on March 27, 2018, a
3636 12copy of which is on file in the office of the city clerk of the city of Revere. 2 of 2
3737 13 (c) The licensing authority of the city of Revere shall not approve the transfer of a license
3838 14granted pursuant to this act to a location outside of the city’s Suffolk Downs Overlay District as
3939 15described in subsection (b), but it may grant a license to a new applicant within the Suffolk
4040 16Downs Overlay District if the applicant files with the licensing authority a letter from the
4141 17department of revenue and a letter from the department of unemployment assistance indicating
4242 18that the license is in good standing with those departments and that all applicable taxes, fees and
4343 19contributions have been paid.
4444 20 (d) If a licensee terminates or fails to renew a license granted under this act or any such
4545 21license is cancelled, revoked or no longer in use, it shall be returned physically, with all of the
4646 22legal rights, privileges, and restrictions pertaining thereto, to the licensing authority which may,
4747 23within 2 years of such return, then grant the license to a new applicant within the city’s Suffolk
4848 24Downs Overlay District under the same conditions as specified in this act, otherwise such license
4949 25shall dissolve.
5050 26 (e) A license granted pursuant to this act shall be issued within 1 year after the effective
5151 27date of this act; provided, however, that if a license is originally granted within that time period,
5252 28such license may be granted to a new applicant pursuant to subsections (c) and (d) thereafter.
5353 29 SECTION 2. This act shall take effect upon its passage.
