28	28	An Act relative to the head injury treatment services trust fund.
29	29	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
30	30	of the same, as follows:
31	31	1 SECTION 1. Section 59 of chapter 10 of the General Laws, as appearing in the 2020
32	32	2Official Edition, is hereby amended by striking out the second sentence and inserting in place
33	33	3thereof the following sentence:-
34	34	4 Said trust fund shall consist of monies paid to the commonwealth pursuant to sections
35	35	513B, 20 and 24.
36	36	6 SECTION 2. Subsection 13B(d) of chapter 90 is hereby amended by adding, after the
37	37	7third time the word “offense” appears, the following words:-
38	38	8 ; provided, that $50 of the fine for the first offense under this subsection shall be
39	39	9deposited into the head injury treatment services trust fund 2 of 4
40	40	10 SECTION 3. Section 20 of chapter 90 is hereby amended in the first sentence of the
41	41	11fourth paragraph by striking out the figure “$50” and inserting in place thereof the following
42	42	12figure:-
43	43	13 $100
44	44	14 SECTION 4. Section 20 of said chapter 90 is hereby further amended in the second
45	45	15sentence of the fourth paragraph by striking out the figure “$50” and inserting thereof the
46	46	16following figure:-
47	47	17 $100
48	48	18 SECTION 5. Subsection 24 (1)(a)(1) of chapter 90 is hereby amended by striking out the
49	49	19second paragraph and inserting in place thereof the following paragraph:-
50	50	20 There shall be an assessment of $250 against a person who is convicted of, is placed on
51	51	21probation for or is granted a continuance without a finding for or otherwise pleads guilty to or
52	52	22admits to a finding of sufficient facts of operating a motor vehicle while under the influence of
53	53	23intoxicating liquor, marijuana, narcotic drugs, depressants or stimulant substances under this
54	54	24section; provided, however, that 100 per cent of the amount collected under this assessment shall
55	55	25be deposited monthly by the court with the state treasurer for who shall deposit it into the head
56	56	26injury treatment services trust fund.
57	57	27 SECTION 6. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
58	58	28fourth paragraph by inserting at the end thereof the following:- 3 of 4
59	59	29 75 percent of the fines collected in this subsection shall be deposited monthly by the
60	60	30court with the state treasurer who shall deposit these funds into the head injury treatment services
61	61	31trust fund.
62	62	32 SECTION 7. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the fifth
63	63	33paragraph by inserting at the end thereof the following:-
64	64	34 75 percent of the fines collected in this subsection shall be deposited monthly by the
65	65	35court with the state treasurer who shall deposit these funds into the head injury treatment services
66	66	36trust fund.
67	67	37 SECTION 8. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the sixth
68	68	38paragraph by inserting at the end thereof the following:-
69	69	39 75 percent of the fines collected in this subsection shall be deposited monthly by the
70	70	40court with the state treasurer who shall deposit these funds into the head injury treatment services
71	71	41trust fund.
72	72	42 SECTION 9. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
73	73	43seventh paragraph by inserting at the end thereof the following:-
74	74	44 75 percent of the fines collected in this subsection shall be deposited monthly by the
75	75	45court with the state treasurer who shall deposit these funds into the head injury treatment services
76	76	46trust fund.
77	77	47 SECTION 10. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
78	78	48eighth paragraph by inserting at the end thereof the following:- 4 of 4
79	79	49 75 percent of the fines collected in this subsection shall be deposited monthly by the
80	80	50court with the state treasurer who shall deposit these funds into the head injury treatment services
81	81	51trust fund.
82	82	52 SECTION 11. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
83	83	53ninth paragraph by inserting at the end thereof the following:-
84	84	54 75 percent of the fines collected in this subsection shall be deposited monthly by the
85	85	55court with the state treasurer who shall deposit these funds into the head injury treatment services
86	86	56trust fund.
87	87	57 SECTION 12 Subsection 24 (1)(a)(1) of Chapter 90 is further amended in the tenth
88	88	58paragraph by inserting at the end thereof the following:-
89	89	59 75 percent of the fines collected in this subsection shall be deposited monthly by the
90	90	60court with the state treasurer who shall deposit these funds into the head injury treatment services
91	91	61trust fund.
92	92	62 SECTION 13. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
93	93	63eleventh paragraph by inserting at the end thereof the following:-
94	94	64 75 percent of the fines collected in this section shall be deposited monthly by the court
95	95	65with the state treasurer who shall deposit these funds into the head injury treatment services trust
96	96	66fund.
