2828 An Act relative to the head injury treatment services trust fund.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 59 of chapter 10 of the General Laws, as appearing in the 2020
3232 2Official Edition, is hereby amended by striking out the second sentence and inserting in place
3333 3thereof the following sentence:-
3434 4 Said trust fund shall consist of monies paid to the commonwealth pursuant to sections
3535 513B, 20 and 24.
3636 6 SECTION 2. Subsection 13B(d) of chapter 90 is hereby amended by adding, after the
3737 7third time the word “offense” appears, the following words:-
3838 8 ; provided, that $50 of the fine for the first offense under this subsection shall be
3939 9deposited into the head injury treatment services trust fund 2 of 4
4040 10 SECTION 3. Section 20 of chapter 90 is hereby amended in the first sentence of the
4141 11fourth paragraph by striking out the figure “$50” and inserting in place thereof the following
4242 12figure:-

4444 14 SECTION 4. Section 20 of said chapter 90 is hereby further amended in the second
4545 15sentence of the fourth paragraph by striking out the figure “$50” and inserting thereof the
4646 16following figure:-

4848 18 SECTION 5. Subsection 24 (1)(a)(1) of chapter 90 is hereby amended by striking out the
4949 19second paragraph and inserting in place thereof the following paragraph:-
5050 20 There shall be an assessment of $250 against a person who is convicted of, is placed on
5151 21probation for or is granted a continuance without a finding for or otherwise pleads guilty to or
5252 22admits to a finding of sufficient facts of operating a motor vehicle while under the influence of
5353 23intoxicating liquor, marijuana, narcotic drugs, depressants or stimulant substances under this
5454 24section; provided, however, that 100 per cent of the amount collected under this assessment shall
5555 25be deposited monthly by the court with the state treasurer for who shall deposit it into the head
5656 26injury treatment services trust fund.
5757 27 SECTION 6. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
5858 28fourth paragraph by inserting at the end thereof the following:- 3 of 4
5959 29 75 percent of the fines collected in this subsection shall be deposited monthly by the
6060 30court with the state treasurer who shall deposit these funds into the head injury treatment services
6161 31trust fund.
6262 32 SECTION 7. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the fifth
6363 33paragraph by inserting at the end thereof the following:-
6464 34 75 percent of the fines collected in this subsection shall be deposited monthly by the
6565 35court with the state treasurer who shall deposit these funds into the head injury treatment services
6666 36trust fund.
6767 37 SECTION 8. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the sixth
6868 38paragraph by inserting at the end thereof the following:-
6969 39 75 percent of the fines collected in this subsection shall be deposited monthly by the
7070 40court with the state treasurer who shall deposit these funds into the head injury treatment services
7171 41trust fund.
7272 42 SECTION 9. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
7373 43seventh paragraph by inserting at the end thereof the following:-
7474 44 75 percent of the fines collected in this subsection shall be deposited monthly by the
7575 45court with the state treasurer who shall deposit these funds into the head injury treatment services
7676 46trust fund.
7777 47 SECTION 10. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
7878 48eighth paragraph by inserting at the end thereof the following:- 4 of 4
7979 49 75 percent of the fines collected in this subsection shall be deposited monthly by the
8080 50court with the state treasurer who shall deposit these funds into the head injury treatment services
8181 51trust fund.
8282 52 SECTION 11. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
8383 53ninth paragraph by inserting at the end thereof the following:-
8484 54 75 percent of the fines collected in this subsection shall be deposited monthly by the
8585 55court with the state treasurer who shall deposit these funds into the head injury treatment services
8686 56trust fund.
8787 57 SECTION 12 Subsection 24 (1)(a)(1) of Chapter 90 is further amended in the tenth
8888 58paragraph by inserting at the end thereof the following:-
8989 59 75 percent of the fines collected in this subsection shall be deposited monthly by the
9090 60court with the state treasurer who shall deposit these funds into the head injury treatment services
9191 61trust fund.
9292 62 SECTION 13. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the
9393 63eleventh paragraph by inserting at the end thereof the following:-
9494 64 75 percent of the fines collected in this section shall be deposited monthly by the court
9595 65with the state treasurer who shall deposit these funds into the head injury treatment services trust
9696 66fund.
