An Act relative to the head injury treatment services trust fund.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. Section 59 of chapter 10 of the General Laws, as appearing in the 2020 
2Official Edition, is hereby amended by striking out the second sentence and inserting in place 
3thereof the following sentence:-
4 Said trust fund shall consist of monies paid to the commonwealth pursuant to sections 
513B, 20 and 24.
6 SECTION 2. Subsection 13B(d) of chapter 90 is hereby amended by adding, after the 
7third time the word “offense” appears, the following words:-
8 ; provided, that $50 of the fine for the first offense under this subsection shall be 
9deposited into the head injury treatment services trust fund 2 of 4
10 SECTION 3. Section 20 of chapter 90 is hereby amended in the first sentence of the 
11fourth paragraph by striking out the figure “$50” and inserting in place thereof the following 
12figure:-

14 SECTION 4. Section 20 of said chapter 90 is hereby further amended in the second 
15sentence of the fourth paragraph by striking out the figure “$50” and inserting thereof the 
16following figure:-

18 SECTION 5. Subsection 24 (1)(a)(1) of chapter 90 is hereby amended by striking out the 
19second paragraph and inserting in place thereof the following paragraph:-
20 There shall be an assessment of $250 against a person who is convicted of, is placed on 
21probation for or is granted a continuance without a finding for or otherwise pleads guilty to or 
22admits to a finding of sufficient facts of operating a motor vehicle while under the influence of 
23intoxicating liquor, marijuana, narcotic drugs, depressants or stimulant substances under this 
24section; provided, however, that 100 per cent of the amount collected under this assessment shall 
25be deposited monthly by the court with the state treasurer for who shall deposit it into the head 
26injury treatment services trust fund.
27 SECTION 6. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the 
28fourth paragraph by inserting at the end thereof the following:- 3 of 4
29 75 percent of the fines collected in this subsection shall be deposited monthly by the 
30court with the state treasurer who shall deposit these funds into the head injury treatment services 
31trust fund.
32 SECTION 7. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the fifth 
33paragraph by inserting at the end thereof the following:-
34 75 percent of the fines collected in this subsection shall be deposited monthly by the 
35court with the state treasurer who shall deposit these funds into the head injury treatment services 
36trust fund.
37 SECTION 8. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the sixth 
38paragraph by inserting at the end thereof the following:-
39 75 percent of the fines collected in this subsection shall be deposited monthly by the 
40court with the state treasurer who shall deposit these funds into the head injury treatment services 
41trust fund.
42 SECTION 9. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the 
43seventh paragraph by inserting at the end thereof the following:-
44 75 percent of the fines collected in this subsection shall be deposited monthly by the 
45court with the state treasurer who shall deposit these funds into the head injury treatment services 
46trust fund.
47 SECTION 10. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the 
48eighth paragraph by inserting at the end thereof the following:- 4 of 4
49 75 percent of the fines collected in this subsection shall be deposited monthly by the 
50court with the state treasurer who shall deposit these funds into the head injury treatment services 
51trust fund.
52 SECTION 11. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the 
53ninth paragraph by inserting at the end thereof the following:-
54 75 percent of the fines collected in this subsection shall be deposited monthly by the 
55court with the state treasurer who shall deposit these funds into the head injury treatment services 
56trust fund.
57 SECTION 12 Subsection 24 (1)(a)(1) of Chapter 90 is further amended in the tenth 
58paragraph by inserting at the end thereof the following:-
59 75 percent of the fines collected in this subsection shall be deposited monthly by the 
60court with the state treasurer who shall deposit these funds into the head injury treatment services 
61trust fund.
62 SECTION 13. Subsection 24 (1)(a)(1) of Chapter 90 is hereby further amended in the 
63eleventh paragraph by inserting at the end thereof the following:-
64 75 percent of the fines collected in this section shall be deposited monthly by the court 
65with the state treasurer who shall deposit these funds into the head injury treatment services trust 
66fund.
