| 29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 30 | 30 | | of the same, as follows: |
|---|
| 31 | 31 | | 1 Notwithstanding any general or special law to the contrary, the Department of |
|---|
| 32 | 32 | | 2Professional Licensure shall establish a recording and public notification system of non- |
|---|
| 33 | 33 | | 3compliance with any provisions in Chapter 148, or any regulations, requirements, and statues |
|---|
| 34 | 34 | | 4pertaining to cutting, welding, and hot works processes. Said system shall include: an online |
|---|
| 35 | 35 | | 5database, an automated notification system to alert property owners, the general public, and |
|---|
| 36 | 36 | | 6insurance companies. The Department of Fire Services, and any municipal or governmental |
|---|
| 37 | 37 | | 7public safety agency that administers such violations, shall regularly notify the DPL of any |
|---|
| 38 | 38 | | 8violations. Violations shall include but not be limited to: failure to receive a Hot Works training |
|---|
| 39 | 39 | | 9certification prior to performing hot work, failure to perform hot work in accordance with DFS |
|---|
| 40 | 40 | | 10and municipal regulations, intentionally wrongfully identifying oneself for the purpose of 2 of 2 |
|---|
| 41 | 41 | | 11performing hot work, or knowingly allowing the performance of hot work by someone without |
|---|
| 42 | 42 | | 12proper certification. |
