2727 An Act authorizing the town of Rutland to increase the membership of the board of selectmen.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Notwithstanding the provisions of section 1 of chapter 41 or of any general
3131 2or special law to the contrary, there shall be in the town of Rutland a 5-member select board,
3232 3with each member to be elected for terms of three years so arranged so that the term of at least 1
3333 4member shall expire each year. The select board, as the chief executive officer of the town, shall
3434 5have the powers and duties of a board of selectmen under the provisions of any general or special
3535 6law.
3636 7 SECTION 2. Notwithstanding the provisions of section 21 or 69D of chapter 41 of the
3737 8general laws, or any general or special law to the contrary, there shall be in the Town of Rutland
3838 9a 5-member board of public works. the select board shall serve as the board of public works and
3939 10have all the powers and duties of a board of public works under the provisions of any general or
4040 11special law. 2 of 2
4141 12 SECTION 3. Notwithstanding section 21 of chapter 40 of the general laws, the town
4242 13clerk, following consultation with the select board, shall replace any reference in the general
4343 14bylaws from: "board of selectmen" to "select board"; "selectman" to "select board member";
4444 15"chairman" to "chair" and to make such other grammatical changes as may be necessary and
4545 16appropriate.
4646 17 SECTION 4. Action taken by the select board, board of public works, and the town
4747 18meeting increasing the size of the select board and authorizing the select board to act as the
4848 19board of public works shall hereby be ratified, validated, and confirmed to the same extent as if
4949 20the act had been in place prior thereto.
5050 21 SECTION 5. Members of the select board serving as of the effective date of this act shall
5151 22continue to serve out the remainder of their unexpired terms or sooner vacating of the office.
5252 23 SECTION 6. This act shall take effect upon its passage.
