No. 2371 By Ms. Gobi, a petition (accompanied by bill, Senate, No. 2371) of Anne M. Gobi and Kimberly N. Ferguson (by vote of the town) for legislation to authorize the town of Rutland to increase the membership of the board of selectmen from 3 members to 5 members. Municipalities and Regional Government. [Local approval received] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act authorizing the town of Rutland to increase the membership of the board of selectmen. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Notwithstanding the provisions of section 1 of chapter 41 or of any general 2or special law to the contrary, there shall be in the town of Rutland a 5-member select board, 3with each member to be elected for terms of three years so arranged so that the term of at least 1 4member shall expire each year. The select board, as the chief executive officer of the town, shall 5have the powers and duties of a board of selectmen under the provisions of any general or special 6law. 7 SECTION 2. Notwithstanding the provisions of section 21 or 69D of chapter 41 of the 8general laws, or any general or special law to the contrary, there shall be in the Town of Rutland 9a 5-member board of public works. the select board shall serve as the board of public works and 10have all the powers and duties of a board of public works under the provisions of any general or 11special law. 2 of 2 12 SECTION 3. Notwithstanding section 21 of chapter 40 of the general laws, the town 13clerk, following consultation with the select board, shall replace any reference in the general 14bylaws from: "board of selectmen" to "select board"; "selectman" to "select board member"; 15"chairman" to "chair" and to make such other grammatical changes as may be necessary and 16appropriate. 17 SECTION 4. Action taken by the select board, board of public works, and the town 18meeting increasing the size of the select board and authorizing the select board to act as the 19board of public works shall hereby be ratified, validated, and confirmed to the same extent as if 20the act had been in place prior thereto. 21 SECTION 5. Members of the select board serving as of the effective date of this act shall 22continue to serve out the remainder of their unexpired terms or sooner vacating of the office. 23 SECTION 6. This act shall take effect upon its passage.
