| 21 | 21 | | An Act authorizing the appointment of special police officers in the town of Charlton. |

| 22 | 22 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 23 | 23 | | of the same, as follows: |
|---|
| 24 | 24 | | 1 SECTION 1. The chief of police of the town of Charlton may appoint, if the chief deems |
|---|
| 25 | 25 | | 2necessary, former police officers who are retired for superannuation in good standing as special |
|---|
| 26 | 26 | | 3police officers for the purpose of performing police details or any other police duties arising |
|---|
| 27 | 27 | | 4from or during the course of police detail work, whether or not related to the detail work. Prior to |
|---|
| 28 | 28 | | 5appointment under this act, a special police officer shall pass a medical examination conducted |
|---|
| 29 | 29 | | 6by a physician or other certified professional chosen by the town to determine that the special |
|---|
| 30 | 30 | | 7police officer is capable of performing the essential duties of a special police officer, the cost of |
|---|
| 31 | 31 | | 8which shall be borne by the special police officer. |
|---|
| 32 | 32 | | 9 SECTION 2. Notwithstanding section 1 of chapter 32 of the General Laws or any other |
|---|
| 33 | 33 | | 10general or special law to the contrary, a special police officer appointed pursuant to this act shall |
|---|
| 34 | 34 | | 11not be subject to the maximum age restrictions applied to regular officers under chapter 32 of the |
|---|
| 35 | 35 | | 12General Laws; provided, however, that a special police officer appointed pursuant to this act |
|---|
| 36 | 36 | | 13shall not be eligible to serve as a special police officer upon reaching the age of 70. 2 of 2 |

| 37 | 37 | | 14 SECTION 3. Special police officers appointed under this act shall be subject to the |
|---|
| 38 | 38 | | 15limitation on hours worked and other restrictions on earnings as provided in paragraph (b) of |
|---|
| 39 | 39 | | 16section 91 of chapter 32 of the General Laws. |
|---|
| 40 | 40 | | 17 SECTION 4. Special police officers shall be subject to the rules and regulations, policies, |
|---|
| 41 | 41 | | 18procedures and requirements of the chief of police of the town of Charlton including, but not |
|---|
| 42 | 42 | | 19limited to, restrictions on the type of detail assignments, requirements regarding medical |
|---|
| 43 | 43 | | 20examinations to determine continuing capability to perform the duties of a special police officer, |
|---|
| 44 | 44 | | 21requirements for training, requirements for firearms licensing and qualifications and |
|---|
| 45 | 45 | | 22requirements regarding uniforms and equipment. Such special police officers shall comply with |
|---|
| 46 | 46 | | 23all requirements of chapter 6E of the General Laws, including: (i) maintaining certification and |
|---|
| 47 | 47 | | 24good standing with the Massachusetts Peace Officer Standards and Training Commission; and |
|---|
| 48 | 48 | | 25(ii) complying with all annual in-service and other training requirements mandated by the |
|---|
| 49 | 49 | | 26municipal police training committee. |
|---|
| 50 | 50 | | 27 SECTION 5. This act shall take effect upon passage. |
