2121 An Act authorizing the appointment of special police officers in the town of Charlton.
2222 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2323 of the same, as follows:
2424 1 SECTION 1. The chief of police of the town of Charlton may appoint, if the chief deems
2525 2necessary, former police officers who are retired for superannuation in good standing as special
2626 3police officers for the purpose of performing police details or any other police duties arising
2727 4from or during the course of police detail work, whether or not related to the detail work. Prior to
2828 5appointment under this act, a special police officer shall pass a medical examination conducted
2929 6by a physician or other certified professional chosen by the town to determine that the special
3030 7police officer is capable of performing the essential duties of a special police officer, the cost of
3131 8which shall be borne by the special police officer.
3232 9 SECTION 2. Notwithstanding section 1 of chapter 32 of the General Laws or any other
3333 10general or special law to the contrary, a special police officer appointed pursuant to this act shall
3434 11not be subject to the maximum age restrictions applied to regular officers under chapter 32 of the
3535 12General Laws; provided, however, that a special police officer appointed pursuant to this act
3636 13shall not be eligible to serve as a special police officer upon reaching the age of 70. 2 of 2
3737 14 SECTION 3. Special police officers appointed under this act shall be subject to the
3838 15limitation on hours worked and other restrictions on earnings as provided in paragraph (b) of
3939 16section 91 of chapter 32 of the General Laws.
4040 17 SECTION 4. Special police officers shall be subject to the rules and regulations, policies,
4141 18procedures and requirements of the chief of police of the town of Charlton including, but not
4242 19limited to, restrictions on the type of detail assignments, requirements regarding medical
4343 20examinations to determine continuing capability to perform the duties of a special police officer,
4444 21requirements for training, requirements for firearms licensing and qualifications and
4545 22requirements regarding uniforms and equipment. Such special police officers shall comply with
4646 23all requirements of chapter 6E of the General Laws, including: (i) maintaining certification and
4747 24good standing with the Massachusetts Peace Officer Standards and Training Commission; and
4848 25(ii) complying with all annual in-service and other training requirements mandated by the
4949 26municipal police training committee.
5050 27 SECTION 5. This act shall take effect upon passage.
