| 30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 31 | 31 | | of the same, as follows: |
|---|
| 32 | 32 | | 1 SECTION 1. Section 1 of chapter 314 of the Acts of 1993 is hereby amended by striking |
|---|
| 33 | 33 | | 2out the words “the expansion of the town of Tewksbury baseball facilities” and inserting in place |
|---|
| 34 | 34 | | 3thereof the following:- “general recreational purposes, including, but not limited to, the town of |
|---|
| 35 | 35 | | 4Tewksbury baseball facilities and other active and passive recreational activities”. |

| 36 | 36 | | 5 SECTION 2. Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General |
|---|
| 37 | 37 | | 6Laws or any other general or special law to the contrary, the commissioner of capital asset |
|---|
| 38 | 38 | | 7management and maintenance may amend the restriction described in a deed recorded in the |
|---|
| 39 | 39 | | 8Middlesex north registry of deeds in book 10054, page 109 to allow the parcel of land described |
|---|
| 40 | 40 | | 9therein to be used for general recreational purposes. |

| 41 | 41 | | 10 SECTION 3. Notwithstanding any general or special law to the contrary, the town of |

| 42 | 42 | | 11Tewksbury shall be responsible for all costs and expenses of any transaction authorized by this 2 of 2 |

| 43 | 43 | | 12act as determined by the commissioner of capital asset management and maintenance including, |
|---|
| 44 | 44 | | 13but not limited to, the costs of any recording fees or deed preparation. |

| 45 | 45 | | 14 SECTION 4. This act shall take effect upon its passage. |
