| 14 | 14 | | Whereas, The deferred operation of this act would tend to defeat its purpose, which is to |
|---|
| 15 | 15 | | authorize forthwith the change of use a certain parcel of land in the town of Tewksbury, |
|---|
| 16 | 16 | | therefore it is hereby declared to be an emergency law, necessary for the immediate preservation |
|---|
| 17 | 17 | | of the public convenience. |
|---|
| 18 | 18 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 19 | 19 | | of the same, as follows: |
|---|
| 20 | 20 | | 1 SECTION 1. (a) Section 1 of chapter 314 of the acts of 1993 is hereby amended by |
|---|
| 21 | 21 | | 2striking out, in line 6, the words “the expansion of the town of Tewksbury baseball facilities” and |
|---|
| 22 | 22 | | 3inserting in place thereof the following words:- general recreational purposes including, but not |
|---|
| 23 | 23 | | 4limited to, Tewksbury baseball facilities and other active and passive recreational activities. |

| 24 | 24 | | 5 (b) Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws, |
|---|
| 25 | 25 | | 6section 2 of chapter 314 of the acts of 1993 or any other general or special law to the contrary, |
|---|
| 26 | 26 | | 7the commissioner of capital asset management and maintenance may amend the restriction in a |
|---|
| 27 | 27 | | 8deed recorded in the Middlesex northern district registry of deeds in book 10054, page 109 to |
|---|
| 28 | 28 | | 9allow the parcel of land described therein to be used for general recreational purposes. 2 of 2 |

| 29 | 29 | | 10 (c) Notwithstanding any general or special law to the contrary, the town of Tewksbury |
|---|
| 30 | 30 | | 11shall be responsible for all costs and expenses of any transaction authorized in this act as |
|---|
| 31 | 31 | | 12determined by the commissioner of capital asset management and maintenance including, but not |
|---|
| 32 | 32 | | 13limited to, the costs of any recording fees or deed preparation. |
