2121 An Act ensuring domestic violence victims' protections for all employees in the Commonwealth.
2222 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2323 of the same, as follows:
2424 1 SECTION 1. Section 52E of chapter 149 of the General Laws, as appearing in the 2022
2525 2Official Edition, is hereby amended by inserting after the definition of “Abusive behavior” the
2626 3following 2 definitions:-
2727 4 “Client employer”, a business entity that obtains or is provided workers to perform labor
2828 5or services within its usual course of business from a third party, including, but not limited to, a
2929 6staffing agency as defined in section 159C.
3030 7 "Contract worker”, an individual who performs labor or services for a client employer but
3131 8is not considered an employee under section 148B, including individuals who are contracted for
3232 9work by client employers.
3333 10 SECTION 2. Said section 52E of said chapter 149, as so appearing, is hereby further
3434 11amended by striking out, in line 36, the words “An employer shall permit an employee” and
3535 12inserting in place thereof the following words:- An employer or a client employer shall permit an
3636 13employee or a contract worker.
