| 22 | 22 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 23 | 23 | | of the same, as follows: |
|---|
| 24 | 24 | | 1 SECTION 1. Section 52E of chapter 149 of the General Laws, as appearing in the 2022 |
|---|
| 25 | 25 | | 2Official Edition, is hereby amended by inserting after the definition of “Abusive behavior” the |
|---|
| 26 | 26 | | 3following 2 definitions:- |
|---|
| 27 | 27 | | 4 “Client employer”, a business entity that obtains or is provided workers to perform labor |
|---|
| 28 | 28 | | 5or services within its usual course of business from a third party, including, but not limited to, a |
|---|
| 29 | 29 | | 6staffing agency as defined in section 159C. |
|---|
| 30 | 30 | | 7 "Contract worker”, an individual who performs labor or services for a client employer but |
|---|
| 31 | 31 | | 8is not considered an employee under section 148B, including individuals who are contracted for |
|---|
| 32 | 32 | | 9work by client employers. |
|---|
| 33 | 33 | | 10 SECTION 2. Said section 52E of said chapter 149, as so appearing, is hereby further |
|---|
| 34 | 34 | | 11amended by striking out, in line 36, the words “An employer shall permit an employee” and |
|---|
| 35 | 35 | | 12inserting in place thereof the following words:- An employer or a client employer shall permit an |
|---|
| 36 | 36 | | 13employee or a contract worker. |
