2525 An Act improving access to breast pumps.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Chapter 32A of the General Laws is hereby amended by adding the
2929 2following section:-
3030 3 Section 31. (a) As used in this section, “multi-user breast pump” shall mean a breast
3131 4pump that is: (i) capable of initiating and supporting milk supply; (ii) able to be used by multiple
3232 5users safely and hygienically; (iii) durable enough to be used by a mother who is expressing 8
3333 6times per day or more; (iv) is made for heavy usage with a long motor life; (v) operating using a
3434 7closed system; (vi) is capable of suction power from 0 to 300 mmHg; (vii) has a multiphase
3535 8system or the ability to customize vacuum and cycling for each user; and (viii) is run on
3636 9electricity, not batteries alone.
3737 10 (b) The commission shall provide to an active or retired employee of the commonwealth
3838 11who is insured under the group insurance commission coverage for the cost of the rental and
3939 12usage of a multi-user breast pump by the mother of a newborn infant who is receiving care at an 2 of 9
4040 13intensive care or special care nursery, or has cardiac, neurological, or oral anomalies that prevent
4141 14direct feeding at the breast, until such time as the infant is discharged, or until the mother is no
4242 15longer pumping breastmilk. The multi-user breast pump shall be made available to the user
4343 16within 24 hours of maternal hospital discharge.
4444 17 (c) The commission shall provide to an active or retired employee of the commonwealth
4545 18who is insured under the group insurance commission, and eligible for a covered multi-user
4646 19breast pump under this section, coverage for: (i) periodic replacement parts for the multi-user
4747 20breast pump including, but not limited to, connectors, valves, tubing, backflow protectors, and
4848 21flanges; (ii) breast milk storage bags; and (iii) microwave bags for sterilizing the multi-user
4949 22breast pump parts.
5050 23 (d) The commission shall provide to an active or retired employee of the commonwealth
5151 24who is insured under the group insurance commission, and eligible for a covered multi-user
5252 25breast pump under this section, coverage for: (i) an initial assessment, instruction and fitting by
5353 26an International Board Certified Lactation Consultant (IBCLC); and (ii) ongoing assessment,
5454 27support and refitting as needed by an IBCLC.
5555 28 SECTION 2. Chapter 118E of the General Laws is hereby amended by inserting after
5656 29section 10N the following section:-
5757 30 Section 10O. (a) As used in this section, “multi-user breast pump” shall mean a breast
5858 31pump that is: (i) capable of initiating and supporting milk supply; (ii) able to be used by multiple
5959 32users safely and hygienically; (iii) durable enough to be used by a mother who is expressing 8
6060 33times per day or more; (iv) is made for heavy usage with a long motor life; (v) operating using a
6161 34closed system; (vi) is capable of suction power from 0 to 300 mmHg; (vii) has a multiphase 3 of 9
6262 35system or the ability to customize vacuum and cycling for each user; and (viii) is run on
6363 36electricity, not batteries alone.
6464 37 (b) The division and its contracted health insurers, health plans, health maintenance
6565 38organizations, behavioral health management firms and third-party administrators under contract
6666 39to a Medicaid managed care organization or primary care clinician plan shall provide coverage
6767 40for the cost of the rental and usage of a multi-user breast pump by the mother of a newborn
6868 41infant who is receiving care at an intensive care or special care nursery, or has cardiac,
6969 42neurological, or oral anomalies that prevent direct feeding at the breast, until such time as the
7070 43infant is discharged, or until the mother is no longer pumping breastmilk. The multi-user breast
7171 44pump shall be made available to the user within 24 hours of maternal hospital discharge.
7272 45 (c) The division and its contracted health insurers, health plans, health maintenance
7373 46organizations, behavioral health management firms and third-party administrators under contract
7474 47to a Medicaid managed care organization or primary care clinician plan shall provide an
7575 48individual, who is eligible for a covered multi-user breast pump under this section, coverage for:
7676 49(i) periodic replacement parts for the multi-user breast pump including, but not limited to,
7777 50connectors, valves, tubing, backflow protectors, and flanges; (ii) breast milk storage bags; and
7878 51(iii) microwave bags for sterilizing the multi-user breast pump parts.
7979 52 (d) The division and its contracted health insurers, health plans, health maintenance
8080 53organizations, behavioral health management firms and third-party administrators under contract
8181 54to a Medicaid managed care organization or primary care clinician plan shall provide an
8282 55individual, who is eligible for a covered multi-user breast pump under this section, coverage for:
8383 56(i) an initial assessment, instruction and fitting by an International Board Certified Lactation 4 of 9
8484 57Consultant (IBCLC); and (ii) ongoing assessment, support and refitting as needed and prescribed
8585 58by provider, by an IBCLC.
8686 59 SECTION 3. Chapter 175 of the General Laws is hereby amended by inserting after
8787 60section 47PP the following section:-
8888 61 Section 47QQ. (a) As used in this section, “multi-user breast pump” shall mean a breast
8989 62pump that is: (i) capable of initiating and supporting milk supply; (ii) able to be used by multiple
9090 63users safely and hygienically; (iii) durable enough to be used by a mother who is expressing 8
9191 64times per day or more; (iv) is made for heavy usage with a long motor life; (v) operating using a
9292 65closed system; (vi) is capable of suction power from 0 to 300 mmHg; (vii) has a multiphase
9393 66system or the ability to customize vacuum and cycling for each user; and (viii) is run on
9494 67electricity, not batteries alone.
9595 68 (b) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
9696 69renewed within the commonwealth, which is considered creditable coverage under section 1 of
9797 70chapter 111M, shall provide coverage for the cost of the rental and usage of a multi-user breast
9898 71pump by the mother of a newborn infant who is receiving care at an intensive care or special care
9999 72nursery, or has cardiac, neurological, or oral anomalies that prevent direct feeding at the breast,
100100 73until such time as the infant is discharged, or until the mother is no longer pumping breast milk.
101101 74The multi-user breast pump should be made available to the user within 24 hours of maternal
102102 75hospital discharge.
103103 76 (c) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
104104 77renewed within the commonwealth, which is considered creditable coverage under section 1 of
105105 78chapter 111M, shall provide an individual, who is eligible for a covered multi-user breast pump 5 of 9
106106 79under this section, coverage for: (i) periodic replacement parts for the multi-user breast pump
107107 80including, but not limited to, connectors, valves, tubing, backflow protectors, and flanges; (ii)
108108 81breast milk storage bags; and (iii) microwave bags for sterilizing the multi-user breast pump
109109 82parts.
110110 83 (d) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
111111 84renewed within the commonwealth, which is considered creditable coverage under section 1 of
112112 85chapter 111M, shall provide an individual, who is eligible for a covered multi-user breast pump
113113 86under this section, coverage for: (i) an initial assessment, instruction and fitting by an
114114 87International Board Certified Lactation Consultant (IBCLC); and (ii) ongoing assessment,
115115 88support and refitting as needed and prescribed by provider, by an IBCLC.
116116 89 SECTION 4. Chapter 176A of the General Laws is hereby amended by inserting after
117117 90section 8QQ the following section:-
118118 91 Section 8RR. (a) As used in this section, “multi-user breast pump” shall mean a breast
119119 92pump that is: (i) capable of initiating and supporting milk supply; (ii) able to be used by multiple
120120 93users safely and hygienically; (iii) durable enough to be used by a mother who is expressing 8
121121 94times per day or more; (iv) is made for heavy usage with a long motor life; (v) operating using a
122122 95closed system; (vi) is capable of suction power from 0 to 300 mmHg; (vii) has a multiphase
123123 96system or the ability to customize vacuum and cycling for each user; and (viii) is run on
124124 97electricity, not batteries alone.
125125 98 (b) Any contract between a subscriber and the corporation under an individual or group
126126 99hospital service plan that is delivered, issued or renewed within the commonwealth shall provide
127127 100coverage for the cost of the rental and usage of a multi-user breast pump by the mother of a 6 of 9
128128 101newborn infant who is receiving care at an intensive care or special care nursery, or has cardiac,
129129 102neurological, or oral anomalies that prevent direct feeding at the breast, until such time as the
130130 103infant is discharged, or until the mother is no longer pumping breast milk. The multi-user breast
131131 104pump shall be made available to the user within 24 hours of maternal hospital discharge.
132132 105 (c) Any contract between a subscriber and the corporation under an individual or group
133133 106hospital service plan that is delivered, issued or renewed within the commonwealth shall provide
134134 107an individual, who is eligible for a covered multi-user breast pump under this section, coverage
135135 108for: (i) periodic replacement parts for the multi-user breast pump including, but not limited to,
136136 109connectors, valves, tubing, backflow protectors, and flanges; (ii) breast milk storage bags; and
137137 110(iii) microwave bags for sterilizing the multi-user breast pump parts.
138138 111 (d) Any contract between a subscriber and the corporation under an individual or group
139139 112hospital service plan that is delivered, issued or renewed within the commonwealth shall provide
140140 113an individual, who is eligible for a covered multi-user breast pump under this section, coverage
141141 114for: (i) an initial assessment, instruction and fitting by an International Board Certified Lactation
142142 115Consultant (IBCLC); and (ii) ongoing assessment, support and refitting as needed and prescribed
143143 116by provider, by an IBCLC.
144144 117 SECTION 5. Chapter 176B of the General laws is hereby amended by inserting after
145145 118section 4QQ the following section:-
146146 119 Section 4RR. (a) As used in this section, “multi-user breast pump” shall mean a breast
147147 120pump that is: (i) capable of initiating and supporting milk supply; (ii) able to be used by multiple
148148 121users safely and hygienically; (iii) durable enough to be used by a mother who is expressing 8
149149 122times per day or more; (iv) is made for heavy usage with a long motor life; (v) operating using a 7 of 9
150150 123closed system; (vi) is capable of suction power from 0 to 300 mmHg; (vii) has a multiphase
151151 124system or the ability to customize vacuum and cycling for each user; and (viii) is run on
152152 125electricity, not batteries alone.
153153 126 (b) Any subscription certificate under an individual or group medical service agreement
154154 127delivered, issued or renewed within the commonwealth shall provide coverage for the cost of the
155155 128rental and usage of a multi-user breast pump by the mother of a newborn infant who is receiving
156156 129care at an intensive care or special care nursery, or has cardiac, neurological, or oral anomalies
157157 130that prevent direct feeding at the breast, until such time as the infant is discharged, or until the
158158 131mother is no longer pumping breastmilk. The multi-user breast pump should be made available
159159 132to the user within 24 hours of maternal hospital discharge.
160160 133 (c) Any subscription certificate under an individual or group medical service agreement
161161 134delivered, issued or renewed within the commonwealth shall provide an individual, who is
162162 135eligible for a covered multi-user breast pump under this section, coverage for: (i) periodic
163163 136replacement parts for the multi-user breast pump including, but not limited to, connectors,
164164 137valves, tubing, backflow protectors, and flanges; (ii) breast milk storage bags; and (iii)
165165 138microwave bags for sterilizing the multi-user breast pump parts.
166166 139 (d) Any subscription certificate under an individual or group medical service agreement
167167 140delivered, issued or renewed within the commonwealth shall provide an individual, who is
168168 141eligible for a covered multi-user breast pump under this section, coverage for: (i) an initial
169169 142assessment, instruction and fitting by an International Board Certified Lactation Consultant
170170 143(IBCLC); and (ii) ongoing assessment, support and refitting as needed and prescribed by
171171 144provider, by an IBCLC. 8 of 9
172172 145 SECTION 6. Chapter 176G of the General Laws is hereby amended by inserting after
173173 146section 4GG the following section:-
174174 147 Section 4HH. (a) As used in this section, “multi-user breast pump” shall mean a breast
175175 148pump that is: (i) capable of initiating and supporting milk supply; (ii) able to be used by multiple
176176 149users safely and hygienically; (iii) durable enough to be used by a mother who is expressing 8
177177 150times per day or more; (iv) is made for heavy usage with a long motor life; (v) operating using a
178178 151closed system; (vi) is capable of suction power from 0 to 300 mmHg; (vii) has a multiphase
179179 152system or the ability to customize vacuum and cycling for each user; and (viii) is run on
180180 153electricity, not batteries alone.
181181 154 (b) An individual or group health maintenance contract that is issued or renewed shall
182182 155provide coverage for the cost of the rental and usage of a multi-user breast pump by the mother
183183 156of a newborn infant who is receiving care at an intensive care or special care nursery, or has
184184 157cardiac, neurological, or oral anomalies that prevent direct feeding at the breast, until such time
185185 158as the infant is discharged, or until the mother is no longer pumping breastmilk. The multi-user
186186 159breast pump should be made available to the user within 24 hours of maternal hospital discharge.
187187 160 (c) An individual or group health maintenance contract that is issued or renewed shall
188188 161provide an individual, who is eligible for a covered multi-user breast pump under this section,
189189 162coverage for: (i) periodic replacement parts for the multi-user breast pump including, but not
