2929 An Act allowing spouses to serve as caregivers.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Chapter 118E of the General Laws is hereby amended by inserting after
3333 2section 13L the following section:-
3434 3 Section 13M. To the extent permitted under federal law, spouses shall be authorized to
3535 4serve as paid caregivers in the MassHealth program for the provision of certain home-based care
3636 5and services.
3737 6 SECTION 2. The executive office of health and human services shall file a state plan
3838 7amendment or waiver application, as may be required, to implement this act no later than 6
3939 8months following the effective date of this act.
