[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE SENATE, NO. 89 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act allowing spouses to serve as caregivers. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Chapter 118E of the General Laws is hereby amended by inserting after 2section 13L the following section:- 3 Section 13M. To the extent permitted under federal law, spouses shall be authorized to 4serve as paid caregivers in the MassHealth program for the provision of certain home-based care 5and services. 6 SECTION 2. The executive office of health and human services shall file a state plan 7amendment or waiver application, as may be required, to implement this act no later than 6 8months following the effective date of this act.
