An Act allowing spouses to serve as caregivers.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. Chapter 118E of the General Laws is hereby amended by inserting after 
2section 13L the following section:-
3 Section 13M. To the extent permitted under federal law, spouses shall be authorized to 
4serve as paid caregivers in the MassHealth program for the provision of certain home-based care 
5and services.
6 SECTION 2. The executive office of health and human services shall file a state plan 
7amendment or waiver application, as may be required, to implement this act no later than 6 
8months following the effective date of this act.
