| 28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 29 | 29 | | of the same, as follows: |

| 30 | 30 | | 1 SECTION 1. Section 11 of chapter 12C of the General Laws, as appearing in the 2020 |
|---|
| 31 | 31 | | 2Official Edition, is hereby amended by striking out the fourth and fifth sentences and inserting in |
|---|
| 32 | 32 | | 3place thereof the following sentences:- |
|---|
| 33 | 33 | | 4 "The center shall assess a penalty against a private payer, provider or provider |
|---|
| 34 | 34 | | 5organization that fails, without just cause, to provide the requested information within 2 weeks |
|---|
| 35 | 35 | | 6following receipt of the written notice required under this paragraph, of up to $5,000 per week |
|---|
| 36 | 36 | | 7for each week of delay after the 2 week period following the private payer's, provider's or |
|---|
| 37 | 37 | | 8provider organization's receipt of the written notice; provided, however, that the maximum |
|---|
| 38 | 38 | | 9annual penalty against a private payer, provider or provider organization under this section shall 2 of 2 |
|---|
| 39 | 39 | | 10be $200,000. An amount collected under this section shall be deposited in the Healthcare |
|---|
| 40 | 40 | | 11Payment Reform Fund established by section 100 of chapter 194 of the acts of 2011. |
