[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE SENATE, NO. 802 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act to ensure timely health care cost reporting. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Section 11 of chapter 12C of the General Laws, as appearing in the 2020 2Official Edition, is hereby amended by striking out the fourth and fifth sentences and inserting in 3place thereof the following sentences:- 4 "The center shall assess a penalty against a private payer, provider or provider 5organization that fails, without just cause, to provide the requested information within 2 weeks 6following receipt of the written notice required under this paragraph, of up to $5,000 per week 7for each week of delay after the 2 week period following the private payer's, provider's or 8provider organization's receipt of the written notice; provided, however, that the maximum 9annual penalty against a private payer, provider or provider organization under this section shall 2 of 2 10be $200,000. An amount collected under this section shall be deposited in the Healthcare 11Payment Reform Fund established by section 100 of chapter 194 of the acts of 2011. 12 The center may promulgate regulations to define “just cause” for the purposes of this 13section.".
