2626 An Act supporting maternal and pediatric health.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 32A of the General Laws is hereby amended by adding the
3030 2following section:-
3131 3 Section 33. Any coverage offered by the commission to an active or retired employee of
3232 4the commonwealth insured under the group insurance commission shall provide coverage for a
3333 5prenatal pediatric visit. The term ‘prenatal pediatric visit’ shall mean an appointment between a
3434 6pregnant person and a pediatrician to provide a foundation on which to build a positive, family-
3535 7pediatric professional partnership as recommended by the American Academy of Pediatrics.
3636 8 SECTION 2. Chapter 118E of the General Laws, as appearing in the 2020 Official
3737 9Edition, is hereby amended by inserting after section 10Q, the following section:-
3838 10 Section 10R. (a) The division and its contracted health insurers, health plans, health
3939 11maintenance organizations, behavioral health management firms and third-party administrators
4040 12under contract to a Medicaid managed care organization or primary care clinician shall provide 2 of 3
4141 13coverage for a prenatal pediatric visit. The term ‘prenatal pediatric visit’ shall mean an
4242 14appointment between a pregnant person and a pediatrician to provide a foundation on which to
4343 15build a positive, family-pediatric professional partnership as recommended by the American
4444 16Academy of Pediatrics.
4545 17 (b) The division shall provide notice to its members regarding the coverage required by
4646 18this section. The notice shall be in writing and prominently positioned in any literature or
4747 19correspondence sent to members and shall be transmitted to members within calendar year when
4848 20annual information is made available to members, or in any other mailing or communication to
4949 21members.
5050 22 SECTION 3. Chapter 175 of the General Laws is hereby amended by inserting after
5151 23section 47TT the following section:-
5252 24 Section 47UU. Any policy, contract, agreement, plan or certificate of insurance issued,
5353 25delivered or renewed within the commonwealth that provides medical expense coverage shall
5454 26provide coverage for a prenatal pediatric visit. The term ‘prenatal pediatric visit’ shall mean an
5555 27appointment between a pregnant person and a pediatrician to provide a foundation on which to
5656 28build a positive, family-pediatric professional partnership as recommended by the American
5757 29Academy of Pediatrics.
5858 30 SECTION 4. Chapter 176A of the General Laws is hereby amended by inserting after
5959 31section 8UU the following section:-
6060 32 Section 8VV. A contract between a subscriber and the corporation under an individual or
6161 33group hospital service plan which is delivered, issued or renewed within the commonwealth shall 3 of 3
6262 34 provide coverage for a prenatal pediatric visit. The term ‘prenatal pediatric visit’ shall
6363 35mean an appointment between a pregnant person and a pediatrician to provide a foundation on
6464 36which to build a positive, family-pediatric professional partnership as recommended by the
6565 37American Academy of Pediatrics.
6666 38 SECTION 5. Chapter 176B of the General Laws is hereby amended by inserting after
6767 39section 4UU the following section:-
6868 40 Section 4VV. Any subscription certificate under an individual or group medical service
6969 41agreement delivered, issued or renewed within the commonwealth shall provide coverage for a
7070 42prenatal pediatric visit. The term ‘prenatal pediatric visit’ shall mean an appointment between a
7171 43pregnant person and a pediatrician to provide a foundation on which to build a positive, family-
7272 44pediatric professional partnership as recommended by the American Academy of Pediatrics.
7373 45 SECTION 6. Chapter 176G of the General Laws is hereby amended by inserting after
7474 46section 4MM the following section:-
7575 47 Section 4NN. Any individual or group health maintenance contract shall provide
7676 48coverage for a prenatal pediatric visit. The term ‘prenatal pediatric visit’ shall mean an
7777 49appointment between a pregnant person and a pediatrician to provide a foundation on which to
7878 50build a positive, family-pediatric professional partnership as recommended by the American
7979 51Academy of Pediatrics.
