2828 An Act relative to fair wages on government subsidized construction projects.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 Add New Third Paragraph to G.L. ch. 149, Section 26:
3232 2 In the employment of mechanics and apprentices, teamsters, chauffeurs and laborers in
3333 3the construction, reconstruction, installation, demolition, maintenance or repair of a building on
3434 4property that is subject to a tax increment financing plan, tax credit, or tax relief provided under
3535 5M.G.L. ch. 40, Section 59 (Tax Increment Financing Plan), Section 60 (Urban Center Housing
3636 6Tax Increment Financing Plan), Section 60A (Manufacturing Workforce Training Tax Increment
3737 7Financing Plan), Section 60B (Workforce Housing Special Tax Assessment Plan), M.G.L. ch.
3838 862, Section 6J and M.G.L ch. 63, Section 38R (Historic Rehabilitation Tax Credit), M.G.L. ch.
3939 940V (Housing Development Incentive Program), and any other provision of law or regulation
4040 10now existing or that may be adopted in the future authorizing a tax increment financing plan, tax 2 of 2
4141 11credit, or any other form of tax relief, the rate per hour of the wages paid to mechanics and
4242 12apprentices, teamsters, chauffeurs and laborers on such building projects shall be not be less than
4343 13the rate or rates of wages to be determined by the commissioner in accordance with the first
4444 14paragraph of this Section 26. Employers of such mechanics and apprentices, teamsters,
4545 15chauffeurs and laborers shall be subject to the requirements of G.L. ch 149, Section 27B with
4646 16respect to work performed on such building projects, and shall submit their weekly certified
4747 17payroll reports and statements of compliance to the authority granting the tax relief in question.
4848 18The payroll records and statements of compliance required by this Section shall be available for
4949 19inspection by any interested party filing a written request to the granting authority for such
5050 20inspection and copying.
