27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
28 | 28 | | of the same, as follows: |
---|
29 | 29 | | 1 Section 1. Notwithstanding any general or special law to the contrary, the executive |
---|
30 | 30 | | 2office of health and human services shall establish an Amputation Prevention Task Force. |
---|
31 | 31 | | 3 The secretary or designee will chair the task force and will make recommendations for |
---|
32 | 32 | | 4task force membership. Members not serving in the General Court will be appointed by the |
---|
33 | 33 | | 5governor. The governor shall ensure that appointments provide diversity of gender, race, and |
---|
34 | 34 | | 6geographical areas. |
---|
35 | 35 | | 7 The task force shall consist of the following members: |
---|
36 | 36 | | 8 (1) Commissioner of the department of public health or a designee; |
---|
37 | 37 | | 9 (2) Assistant Secretary for MassHealth or a designee; |
---|
38 | 38 | | 10 (3) Two members from the Massachusetts House of Representatives as appointed by the |
---|
39 | 39 | | 11Speaker of the House; 2 of 3 |
---|
40 | 40 | | 12 (4) Two members from the Massachusetts Senate as appointed by the Senate President; |
---|
41 | 41 | | 13 (5) One licensed endocrinologist; |
---|
42 | 42 | | 14 (6) One licensed diabetes nurse educator; |
---|
43 | 43 | | 15 (7) A vascular surgeon who has expertise in amputation prevention; |
---|
44 | 44 | | 16 (8) A medical doctor or midlevel practitioner who has expertise in amputation |
---|
45 | 45 | | 17prevention; |
---|
46 | 46 | | 18 (9) A podiatrist with expertise in treating diabetic foot ulcers; |
---|
47 | 47 | | 19 (10) A podiatrist or vascular surgeon with the veterans administration; |

48 | 48 | | 20 (11) A public health provider; |
---|
49 | 49 | | 21 (12) A representative of the Massachusetts Senior Care Association; |
---|
50 | 50 | | 22 (13) One member of the public; |
---|
51 | 51 | | 23 (14) A representative of the American Diabetes Association; and |

52 | 52 | | 24 (15) The task force may add members as it sees fit by a majority vote of the task force |

54 | 54 | | 26 Section 2. Duties. |
---|
55 | 55 | | 27 The task force shall: |
---|
56 | 56 | | 28 (1) advise the secretary and other state agencies on issues related to amputations with a |
---|
57 | 57 | | 29focus on amputation prevention as it relates to diabetic foot ulcers and peripheral arterial disease; 3 of 3 |

58 | 58 | | 30 (2) provide a systematic and cohesive approach toward reducing amputations, including |
---|
59 | 59 | | 31increasing public awareness; |
---|
60 | 60 | | 32 (3) recommend mechanisms to encourage greater cooperation among stakeholders to |
---|
61 | 61 | | 33address amputations in Massachusetts; |
---|
62 | 62 | | 34 (4) make recommendations and identify policy solutions to the state legislature to ensure |
---|
63 | 63 | | 35access to treatments to prevent amputations including: |
---|
64 | 64 | | 36 (a) Coverage policies as it relates to treatment of diabetic foot ulcers including topical |
---|
65 | 65 | | 37oxygen therapy; |
---|
66 | 66 | | 38 (b) Policies to address timely and equitable access to evidence-supported medical tools, |
---|
67 | 67 | | 39technologies, and services to prevent avoidable amputations; |
---|
68 | 68 | | 40 (c) Improve and incentivize quality care to avoid amputations whenever possible; |
---|
69 | 69 | | 41 (d) Policies to promote collaboration |
---|
70 | 70 | | 42 (5) The task force shall publish a report and present it to the Governor, the clerks of the |
---|
71 | 71 | | 43house of representatives and senate, and the chairs of the Joint Committees on Public Health, |
---|
72 | 72 | | 44Health Care Financing, and Financial Services by no later than September 1 of the year |
---|
73 | 73 | | 45following passage into law. |
