30	30	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
31	31	of the same, as follows:
32	32	1 SECTION 1. Section 15F of chapter 6 of the General Laws, as appearing in the 2022
33	33	2Official Edition, is hereby amended by striking out, in lines 2 and 3, the words “Employ
34	34	3Handicapped Persons Week” and inserting in place thereof the following words:- Persons with
35	35	4Disabilities Employment Week.

929	929	898substantial developmental delay or specific congenital or acquired condition with a high
930	930	899probability that the condition will result in a developmental disability if services are not
931	931	900provided; provided, however, that a person who has a developmental disability may be
932	932	901considered to be mentally ill; and provided further, that no person with a developmental
933	933	902disability shall be considered to be mentally ill solely by reason of the person's developmental
934	934	903disability.
935	935	904 ''Person with an intellectual disability'', a person who has a disability, characterized by
936	936	905significant limitations in both intellectual functioning and adaptive behavior as expressed in
937	937	906conceptual, social and practical adaptive skills beginning before age 18 and consistent with the
938	938	907most recent definition provided by the American Association on Intellectual and Developmental
939	939	908Disabilities; provided, however, that in applying this definition, the following shall be
940	940	909considered: (i) limitations in present functioning within the context of community environments
941	941	910typical of the individual's age, peers and culture; (ii) cultural and linguistic diversity and
942	942	911differences in communication, sensory, motor and behavioral factors; (iii) limitations often
943	943	912coexist with strengths within an individual; (iv) an important purpose of describing limitations is
944	944	913to develop a profile of needed supports; and (v) with appropriate personalized supports over a 47 of 61
945	945	914sustained period, the life functioning of a person with an intellectual disability will generally
946	946	915improve; provided further, that a person who has an intellectual disability may be considered to

1229	1229	1198is deaf or person with a hearing disability or other disability.
1230	1230	1199 SECTION 359. Section 23 of chapter 273 of the General Laws, as so appearing, is hereby
1231	1231	1200amended by striking out, in line 1, the words “needy disabled person” and inserting in place
1232	1232	1201thereof the following words:- person with a disability.
1233	1233	1202 SECTION 360. Section 100E of chapter 276 of the General Laws, as so appearing, is
1234	1234	1203hereby amended by striking out the definition of “Disabled person”.
1235	1235	1204 SECTION 361. Said section 100E of said chapter 276, as so appearing, is hereby further
1236	1236	1205amended by inserting after the definition of “Person” the following definition:-
1237	1237	1206 “Person with a disability”,  a person with an intellectual or a developmental disability as
1238	1238	1207defined in section 1 of chapter 123B or who otherwise has a mental or physical disability and, as
1239	1239	1208a result of such mental or physical disability, is wholly or partially dependent on others to meet
1240	1240	1209daily living needs.
1241	1241	1210 SECTION 362. Section 100J of said chapter 276, as so appearing, is hereby amended by
1242	1242	1211striking out, in line 9, the words “disabled person” and inserted in place thereof the following
1243	1243	1212words:- person with a disability.
