An Act dignifying individuals with intellectual or developmental disabilities..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. Section 15F of chapter 6 of the General Laws, as appearing in the 2022 
2Official Edition, is hereby amended by striking out, in lines 2 and 3, the words “Employ 
3Handicapped Persons Week” and inserting in place thereof the following words:- Persons with 
4Disabilities Employment Week.  
5 SECTION 2. Section 15LLLL of said chapter 6, as so appearing, is hereby amended by 
6striking out, in line 2, the word “Autistic” and inserting in place thereof the following word:-

8 SECTION 3. Section 15OOOOO of said chapter 6, as so appearing, is hereby amended 
9by striking out, in line 5, the words “disabled individuals” and inserting in place thereof the

38physical disability and who, as a result of such intellectual, developmental or physical disability, 
39is wholly or partially dependent on others to meet the daily living needs of such person with a 
40disability.

895the individual's need for a combination and sequence of special, interdisciplinary or generic 
896services, supports or other assistance that is of an extended or lifelong duration and is 
897individually planned and coordinated; or (b) an individual under the age of 5 who has a 
898substantial developmental delay or specific congenital or acquired condition with a high 
899probability that the condition will result in a developmental disability if services are not 
900provided; provided, however, that a person who has a developmental disability may be 
901considered to be mentally ill; and provided further, that no person with a developmental 
902disability shall be considered to be mentally ill solely by reason of the person's developmental 
903disability. 
904 ''Person with an intellectual disability'', a person who has a disability, characterized by 
905significant limitations in both intellectual functioning and adaptive behavior as expressed in 
906conceptual, social and practical adaptive skills beginning before age 18 and consistent with the 
907most recent definition provided by the American Association on Intellectual and Developmental 
908Disabilities; provided, however, that in applying this definition, the following shall be 
909considered: (i) limitations in present functioning within the context of community environments 
910typical of the individual's age, peers and culture; (ii) cultural and linguistic diversity and 
911differences in communication, sensory, motor and behavioral factors; (iii) limitations often 
912coexist with strengths within an individual; (iv) an important purpose of describing limitations is 
913to develop a profile of needed supports; and (v) with appropriate personalized supports over a  47 of 61
914sustained period, the life functioning of a person with an intellectual disability will generally 
915improve; provided further, that a person who has an intellectual disability may be considered to 
916be mentally ill; and provided further, that no person with an intellectual disability shall be 
917considered to be mentally ill solely by reason of the person's intellectual disability.

1000inserting in place thereof the following words:- a physician who is incapacitated, has a disability

1002 SECTION 300. Section 28 of said chapter 152, as so appearing, is hereby amended by 
1003striking out, in lines 13 and 14, the words “mentally retarded persons eighteen years of age or 
1004older” and inserting in place thereof the following words:- persons age 18 or older who have an 
1005intellectual disability as defined in the current version of the Diagnostic and Statistical Manual of 
1006Mental Disorders.   
1007 SECTION 301. Section 37A of said chapter 152, as so appearing, is hereby amended by 
1008striking out, in line 1, the word “disabled” and inserting in place thereof the following words:-

1077 “Person with a disability”, a person who has a medically-determinable, permanent

1079Security Income under 42 U.S.C. 1382c(a)(3)(A) and 42 U.S.C. 1382c(a)(3)(C) as in effect at the 
1080time of recording. 
1081 SECTION 324. Section 2 of said chapter 188, as so appearing, is hereby amended by 
1082striking out, in lines 2, 7 and 20, and in lines 39 and 40, the words “elderly or disabled person” 
1083and inserting in place thereof, in each instance, the following words:- elderly person or person 
1084with a disability.

1199 SECTION 359. Section 23 of chapter 273 of the General Laws, as so appearing, is hereby 
1200amended by striking out, in line 1, the words “needy disabled person” and inserting in place 
1201thereof the following words:- person with a disability.   
1202 SECTION 360. Section 100E of chapter 276 of the General Laws, as so appearing, is 
1203hereby amended by striking out the definition of “Disabled person”.   
1204 SECTION 361. Said section 100E of said chapter 276, as so appearing, is hereby further 
1205amended by inserting after the definition of “Person” the following definition:- 
1206 “Person with a disability”,  a person with an intellectual or a developmental disability as 
1207defined in section 1 of chapter 123B or who otherwise has a mental or physical disability and, as 
1208a result of such mental or physical disability, is wholly or partially dependent on others to meet 
1209daily living needs. 
1210 SECTION 362. Section 100J of said chapter 276, as so appearing, is hereby amended by 
1211striking out, in line 9, the words “disabled person” and inserted in place thereof the following 
1212words:- person with a disability.
