2828 An Act relative to trans-inclusive health care access.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Chapter 32A of the General Laws, as appearing in the 2022 Official
3232 2Edition, is hereby amended by inserting after section 17S the following section:-
3333 3 Section 17T. The commission shall not reject a written verification or certification from a
3434 4health care provider, including, but not limited to, a qualified mental health care professional, for
3535 5accessing gender-affirming care, unless the written verification or certification clearly does not
3636 6satisfy minimum requirements under established clinical guidelines, nor shall the commission
3737 7require more than one written verification or certification that the care is required for the
3838 8treatment of gender dysphoria. 2 of 5
3939 9 For purposes of this section, the term “qualified mental health care professional” shall,
4040 10unless the context clearly requires otherwise, mean a mental health professional who meets the
4141 11minimum credentials, training and standards of care for working with gender dysphoric adults
4242 12and adolescents developed by the World Professional Association for Transgender Health.
4343 13 SECTION 2. Chapter 118E of the General Laws, as appearing in the 2022 Official
4444 14Edition, is hereby amended by inserting after section 10Q the following section:-
4545 15 Section 10R. The division shall not reject a written verification or certification from a
4646 16health care provider, including, but not limited to, a qualified mental health care professional, for
4747 17accessing gender-affirming care, unless the written verification or certification clearly does not
4848 18satisfy minimum requirements under established clinical guidelines, nor shall the division require
4949 19more than one written verification or certification that the care is required for the treatment of
5050 20gender dysphoria.
5151 21 For purposes of this section, the term “qualified mental health care professional” shall,
5252 22unless the context clearly requires otherwise, mean a mental health professional who meets the
5353 23minimum credentials, training and standards of care for working with gender dysphoric adults
5454 24and adolescents developed by the World Professional Association for Transgender Health.
5555 25 SECTION 3. Chapter 175 of the General Laws is hereby amended by inserting after
5656 26section 47UU the following section:-
5757 27 Section 47VV. No insurer or producer authorized to issue policies of insurance pursuant
5858 28to sections 108 or 110 shall reject a written verification or certification from a health care
5959 29provider, including, but not limited to, a qualified mental health care professional, for accessing
6060 30gender-affirming care, unless the written verification or certification clearly does not satisfy 3 of 5
6161 31minimum requirements under established clinical guidelines, nor shall any insurer or producer
6262 32require more than one written verification or certification that the care is required for the
6363 33treatment of gender dysphoria.
6464 34 For purposes of this section, the term “qualified mental health care professional” shall,
6565 35unless the context clearly requires otherwise, mean a mental health professional who meets the
6666 36minimum credentials, training and standards of care for working with gender dysphoric adults
6767 37and adolescents developed by the World Professional Association for Transgender Health.
6868 38 SECTION 4. Chapter 176A of the General Laws is hereby amended by inserting after
6969 39section 8VV the following section:-
7070 40 Section 8WW. No corporation subject to this chapter shall reject a written verification or
7171 41certification from a health care provider, including, but not limited to, a qualified mental health
7272 42care professional, for accessing gender-affirming care, unless the written verification or
7373 43certification clearly does not satisfy minimum requirements under established clinical guidelines,
7474 44nor shall the corporation require more than one written verification or certification that the care
7575 45is required for the treatment of gender dysphoria.
7676 46 For purposes of this section, the term “qualified mental health care professional” shall,
7777 47unless the context clearly requires otherwise, mean a mental health professional who meets the
7878 48minimum credentials, training and standards of care for working with gender dysphoric adults
7979 49and adolescents developed by the World Professional Association for Transgender Health.
8080 50 SECTION 5. Chapter 176B of the General Laws, as appearing in the 2022 Official
8181 51Edition, is hereby amended by inserting after section 4VV the following section:- 4 of 5
8282 52 Section 4WW. No corporation subject to this chapter shall reject a written verification or
8383 53certification from a health care provider, including, but not limited to, a qualified mental health
8484 54care professional, for accessing gender-affirming care, unless the written verification or
8585 55certification clearly does not satisfy minimum requirements under established clinical guidelines,
8686 56nor shall the corporation require more than one written verification or certification that the care
8787 57is required for the treatment of gender dysphoria.
8888 58 For purposes of this section, the term “qualified mental health care professional” shall,
8989 59unless the context clearly requires otherwise, mean a mental health professional who meets the
9090 60minimum credentials, training and standards of care for working with gender dysphoric adults
9191 61and adolescents developed by the World Professional Association for Transgender Health.
9292 62 SECTION 6. Chapter 176G of the General Laws is hereby amended by inserting after
9393 63section 4NN the following section:-
9494 64 Section 4OO. No health maintenance organization subject to this chapter, and no officer
9595 65or agent thereof, shall reject a written verification or certification from a health care provider,
9696 66including, but not limited to, a qualified mental health care professional, for accessing gender-
9797 67affirming care, unless the written verification or certification clearly does not satisfy minimum
9898 68requirements under established clinical guidelines, nor shall a health maintenance organization
9999 69require more than one written verification or certification that the care is required for the
100100 70treatment of gender dysphoria.
101101 71 For purposes of this section, the term “qualified mental health care professional” shall,
102102 72unless the context clearly requires otherwise, mean a mental health professional who meets the 5 of 5
103103 73minimum credentials, training and standards of care for working with gender dysphoric adults
104104 74and adolescents developed by the World Professional Association for Transgender Health.
