AN ACT concerning 1 
 
Human Services – Secretary of Aging – Qualifications 2 
 
FOR the purpose of establishing certain qualification requirements for an individual 3 
appointed as the Secretary of Aging; and generally relating to the Department of 4 
Aging. 5 
 
BY repealing and reenacting, with amendments, 6 
 Article – Human Services 7 
Section 10–202 8 
 Annotated Code of Maryland 9 
 (2019 Replacement Volume and 2021 Supplement) 10 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11 
That the Laws of Maryland read as follows: 12 
 
Article – Human Services 13 
 
10–202. 14 
 
 (a) (1) With the advice and consent of the Senate, the Governor shall appoint 15 
the Secretary of Aging. 16 
 
 (2) The Secretary is the head of the Department. 17  2 	HOUSE BILL 430  
 
 
 
 (B) AN INDIVIDUAL APPOINTED AS THE SECRETARY MUST : 1 
 
 (1) HAVE EXTENSIVE EXPER IENCE WITH AND KNOWL EDGE OF: 2 
 
 (I) LAWS, LEGISLATION, AND REGULATIONS RELA TING TO 3 
AGING; AND  4 
 
 (II) PROGRAMS FOR AGING I	NDIVIDUALS, INCLUDING 5 
EVIDENCE–BASED AND DATA –DRIVEN PROGRAMS ; AND 6 
 
 (2) DEMONSTRATE A COMMIT MENT TO THE MISSIONS OF BOTH THE 7 
FEDERAL OLDER AMERICANS ACT AND THE DEPARTMENT ; AND 8 
 
 (3) AT MINIMUM, HOLD A BACHELOR ’S DEGREE. 9 
 
 [(b)] (C) Before taking office, the appointee shall take the oath required by 10 
Article I, § 9 of the Maryland Constitution. 11 
 
 [(c)] (D) (1) The Secretary serves at the pleasure of the Governor and is 12 
responsible directly to the Governor. 13 
 
 (2) The Secretary shall advise the Governor on all matters assigned to the 14 
Department and is responsible for carrying out the Governor’s policies on those matters. 15 
 
 [(d)] (E) The Secretary is entitled to the compensation provided in the State 16 
budget. 17 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 18 
January 20, 2023. 19
