AN ACT concerning 1 
 
Baltimore East–West Corridor – Transit Study – Requirements  2 
 
FOR the purpose of requiring the State Department of Transportation to complete certain 3 
processes and secure a certain decision for the Red Line and a certain MARC rail 4 
extension; requiring the Department to prepare a certain plan; requiring, for certain 5 
fiscal years, that the Governor include in the annual budget bill certain 6 
appropriations for certain purposes; prohibiting the Maryland Transit 7 
Administration, under certain circumstances, from acquiring real property; and 8 
generally relating to the Baltimore metropolitan area east–west corridor. 9

 Preamble 6 
 
 WHEREAS, The Maryland Transit Administration has undertaken the Baltimore 7 
Corridor Transit Study – Red Line for a proposed 10–mile rapid transit line for the 8 
Baltimore metropolitan area; and 9 
 
 WHEREAS, The Red Line transit corridor encompasses a large number of residents, 10 
small and large businesses, schools, churches, and other community institutions, all of 11 
which are deeply concerned about the future of their communities; and 12 
 
 WHEREAS, Effective, high–quality public transportation is important to these 13 
communities; and 14 
 
 WHEREAS, Public transit must be frequently available, reliable, and safe, and must 15 
provide an efficient and economical means to connect community members to major 16 
destinations throughout the Baltimore metropolitan area; and 17 
 
 WHEREAS, First and foremost, the Red Line should improve the public 18 
transportation system in the Baltimore metropolitan area and in the communities 19 
surrounding the Red Line transit corridor, and should be planned in a manner to serve 20 
those communities and foster economic development; and 21 
 
 WHEREAS, It is the intent of the General Assembly that, during the course of 22 
planning and constructing the Red Line project, the Administration adhere to the best 23 
practices of transit planning and implementation; and 24 
 
 WHEREAS, It is the intent of the General Assembly that community members 25 
participate in the planning process for the Red Line project and seek to fairly represent the 26 
interests of all community members; now, therefore, 27 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMB LY OF MARYLAND, 28 
That the Laws of Maryland read as follows: 29

 (A) IN THIS SECTION, “RED LINE” MEANS A RAIL TRANSIT FACILIT Y USING 32 
ONE OR MORE VEHICLES OPERATING IN TANDEM ON A FIXED RAIL IN A 33 
COMBINATION OF AT –GRADE, ELEVATED, AND UNDERGROUND CONF IGURATIONS 34   	HOUSE BILL 632 	3 
 
 
THROUGH BALTIMORE CITY AND BALTIMORE COUNTY ALONG A GENERA LLY EAST 1 
TO WEST ALIGNMENT BE TWEEN THE TER MINUS OF SECURITY BOULEVARD ON THE 2 
WEST AND THE JOHNS HOPKINS BAYVIEW MEDICAL CENTER ON THE EAS T, 3 
CONNECTING AS APPROP RIATE TO OTHER FIXED –ROUTE TRANSIT SERVIC ES. 4 
 
 (B) (1) SUBJECT TO SUBSECTION (C) OF THIS SECTION , THE 5 
DEPARTMENT PROMPTLY SHALL:  6 
 
 (I) UNDERTAKE ALL STEPS NECESSARY TO COMPLETE 7 
PLANNING, PRELIMINARY ENGINEER ING, AND THE NATIONAL ENVIRONMENTAL 8 
POLICY ACT PROCESS AND SECURE A RECORD OF DECISION FOR : 9 
 
 1. THE RED LINE; AND  10 
 
 2. A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 11 
BAYVIEW MEDICAL CENTER; AND  12 
 
 (II) PREPARE A PLAN FOR TH E FUNDING AND FINANC ING OF 13 
THE CONSTRUCTION AND OPERATION OF :  14 
 
 1. THE RED LINE; AND 15 
 
 2. A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 16 
BAYVIEW MEDICAL CENTER.  17 
 
 (2) IN PLANNING THE RED LINE AND MARC RAIL EXTENSION , THE 18 
DEPARTMENT SHALL :  19 
 
 (I) SEEK TO AVOID ANY RES IDENTIAL DISPLACEMEN T;  20 
 
 (II) STUDY THE ECONOMIC AND EMPLOYMENT IMPAC TS OF 21 
CONSTRUCTING AND OPE RATING THE RED LINE AND MARC RAIL EXTENSION ;  22 
 
 (III) CONSIDER MEASURES TO PROTECT AND ENHANCE THE 23 
PHYSICAL AND ECONOMIC WELL–BEING OF THE RESIDEN TS OF THE STUDY AREA ; 24 
AND  25 
 
 (IV) MAKE ITS FINDINGS PUBLICLY AV AILABLE.  26 
 
 (3) THE DEPARTMENT SHALL GIVE DUE CONSIDERATION TO 27 
PREVIOUSLY COMPLETED ENGINEERING AN D ENVIRONMENTAL STUDIES. 28

 (C) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , IN EACH OF 1 
FISCAL YEARS 2024 THROUGH 2027, THE GOVERNOR SHALL INCLUD E IN THE 2 
ANNUAL BUDGET BILL AN APPROPRIATION FRO M THE TRANSPORTATION TRUST 3 
FUND OF AT LEAST $5,000,000, CONTINGENT ON THE RE CEIPT OF FEDERAL FUN DS 4 
TO BE USED TO PROVID E MATCHING FUNDS NEE DED TO CONDUCT AN 5 
ENVIRONMENTAL IMPACT STUDY UNDER THE NATIONAL ENVIRONMENTAL POLICY 6 
ACT FOR:  7 
 
 (I) THE RED LINE; AND  8 
 
 (II) A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 9 
BAYVIEW MEDICAL CENTER.  10 
 
 (2) AN APPROPRIATION REQU IRED UNDER PARAGRAPH (1) OF THIS 11 
SUBSECTION MAY BE RE DUCED BY THE AMOUNT OF THE TOTAL AUTHORI ZED IN THE 12 
PRIOR FISCAL YEAR TO CONDUCT THE ENVIRONMENTAL IMPACT STUDY.  13 
 
 (D) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , FOR FISCAL 14 
YEAR 2024 AND EACH FISCAL YEAR THEREAFTER , THE GOVERNOR SHALL INCLUD E 15 
IN THE ANNUAL BUDGET BILL AN APPROPRIATION FRO M THE TRANSPORTATION 16 
TRUST FUND OF $200,000 TO THE BALTIMORE CITY MAYOR’S OFFICE OF 17 
EMPLOYMENT DEVELOPMENT FO R WORKFORCE DEVELOPM ENT AND SMALL , 18 
MINORITY, AND WOMEN –OWNED BUSINESS DEVEL OPMENT. 19 
 
 (2) IT IS THE INTENT OF T HE GENERAL ASSEMBLY THAT THE FUN DS 20 
APPROPRIATED TO THE BALTIMORE CITY MAYOR’S OFFICE OF EMPLOYMENT 21 
DEVELOPMENT SHALL SUP PLEMENT, AND NOT SUPPLANT , FUNDS OTHERWISE 22 
AVAILABLE FOR THE BALTIMORE CITY MAYOR’S OFFICE OF EMPLOYMENT 23 
DEVELOPMEN T.  24 
 
 (E) IN CONDUCTING THE RED LINE TRANSIT PROJECT, THE 25 
ADMINISTRATION MAY NO T ACQUIRE ANY REAL P ROPERTY FOR PLANNING, 26 
CONSTRUCTION , OPERATION, OR MAINTENANCE OF TH E RED LINE IF THE 27 
ACQUISITION WOULD RE SULT IN INVOLUNTARY RESIDENTIAL DISPLACE MENT.  28 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That it is the intent of the General 29 
Assembly that the Maryland Transit Administration, in cooperation with the local 30 
governments in the Baltimore metropolitan area and appropriate State agencies, develop 31 
and implement workforce development strategies that maximize participation by residents 32 
in the east–west corridor in jobs created by and for east–west corridor transit projects. 33 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That it is the intent of the General 34 
Assembly that the Maryland Congressional Delegation be requested to advocate changes 35 
in federal law and policy that will: 36   	HOUSE BILL 632 	5 
 
 
 
 (1) increase the level of federal funding for and formula participation in 1 
New Starts transit projects to a level consistent with other surface transportation 2 
investments; and 3 
 
 (2) reduce biases in the federal New Starts funding formula against the 4 
northeastern and industrial regions of the United States that have smaller public  5 
rights–of–way and higher utility relocation and environmental hazard mitigation costs. 6 
 
 SECTION 4. AND BE IT FURTHER ENACTED, That Section(s) 2 of Chapter 2 of 7 
the Acts of the General Assembly of the 2006 Special Session be repealed. 8 
 
 SECTION 5. AND BE IT FURTHER ENACTED, That Section(s) 2 of Chapter 3 of 9 
the Acts of the General Assembly of the 2006 Special Session be repealed. 10 
 
 SECTION 6. AND BE IT FURTHER ENACTED, That Section(s) 1 of Chapter 2 of 11 
the Acts of the General Assembly of the 2006 Special Session, as amended by Chapter 570 12 
of the Acts of the General Assembly of 2009, be repealed. 13 
 
 SECTION 7. AND BE IT FURTHER ENACTED, That Section(s) 1 of Chapter 3 of 14 
the Acts of the General Assembly of the 2006 Special Session, as amended by Chapter 570 15 
of the Acts of the General Assembly of 2009, be repealed. 16 
 
 SECTION 8. AND BE IT FURTHER ENACTED, That Chapter 570 of the Acts of the 17 
General Assembly of 2009 be repealed. 18 
 
 SECTION 9. AND BE IT FURTHER ENACTED, That this Act shall take effect July 19 
1, 2022. 20
