AN ACT concerning 1 
 
Baltimore East–West Corridor – Transit Study – Requirements  2 
 
FOR the purpose of requiring the State Department of Transportation to complete certain 3 
processes and secure a certain decision for the Red Line and a certain MARC rail 4 
extension; requiring the Department to prepare a certain plan; requiring, for certain 5 
fiscal years, that the Governor include in the annual budget bill certain 6 
appropriations for certain purposes, subject to the receipt of certain federal funds; 7 
prohibiting the Maryland Transit Administration, under certain circumstances, 8 
from acquiring real property; and generally relating to the Baltimore metropolitan 9 
area east–west corridor. 10

Preamble 19 
 
 WHEREAS, The Maryland Transit Administration has undertaken the Baltimore 20 
Corridor Transit Study – Red Line for a proposed 10–mile rapid transit line for the 21 
Baltimore metropolitan area; and 22 
 
 WHEREAS, The Red Line transit corridor encompasses a large number of residents, 23 
small and large businesses, schools, churches, and other community institutions, all of 24 
which are deeply concerned about the future of their communities; and 25 
 
 WHEREAS, Effective, high–quality public transportation is important to these 26 
communities; and 27 
 
 WHEREAS, Public transit must be frequently available, reliable, and safe, and must 28 
provide an efficient and economical means to connect community members to major 29 
destinations throughout the Baltimore metropolitan area; and 30 
 
 WHEREAS, First and foremost, the Red Line should improve the public 31 
transportation system in the Baltimore metropolitan area and in the communities 32 
surrounding the Red Line transit corridor, and should be planned in a manner to serve 33 
those communities and foster economic development; and 34

 WHEREAS, It is the intent of the General Assembly that, during the course of 1 
planning and constructing the Red Line project, the Administration adhere to the best 2 
practices of transit planning and implementation; and 3 
 
 WHEREAS, It is the intent of the General Assembly that community members 4 
participate in the planning process for the Red Line project and seek to fairly represent the 5 
interests of all community members; now, therefore, 6 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 7 
That the Laws of Maryland read as follows: 8

 (A) IN THIS SECTION, “RED LINE” MEANS A RAIL TRANSIT FACILITY USING 11 
ONE OR MORE VEHICLES OPERATING IN TANDEM ON A FIXED RAIL IN A 12 
COMBINATION OF AT –GRADE, ELEVATED, AND UNDERGROUND CONF IGURATIONS 13 
THROUGH BALTIMORE CITY AND BALTIMORE COUNTY ALONG A GENERA LLY EAST 14 
TO WEST ALIGNMENT BE TWEEN THE TERMINUS O F SECURITY BOULEVARD ON THE 15 
WEST AND THE JOHNS HOPKINS BAYVIEW MEDICAL CENTER ON THE EAST , 16 
CONNECTING AS APPROP RIATE TO OTHER FIXED –ROUTE TRANSIT SERVIC ES. 17 
 
 (B) (1) SUBJECT TO SUBSECTION (C) OF THIS SECTION AND CONTINGENT 18 
ON THE RECEIPT OF FE DERAL FUNDS , THE DEPARTMENT PROMPTLY SHALL :  19 
 
 (I) UNDERTAKE ALL STEPS N ECESSARY TO COMPLETE 20 
PLANNING, PRELIMINARY ENGINEER ING, AND THE NATIONAL ENVIRONMENTAL 21 
POLICY ACT PROCESS AND SECUR E A RECORD OF DECISI ON FOR: 22 
 
 1. THE RED LINE; AND  23 
 
 2. A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 24 
BAYVIEW MEDICAL CENTER; AND  25 
 
 (II) PREPARE A PLAN FOR TH E FUNDING AND FINANC ING OF 26 
THE CONSTRUCTION AND OPERATION OF :  27 
 
 1. THE RED LINE; AND 28 
 
 2. A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 29 
BAYVIEW MEDICAL CENTER.  30 
 
 (2) IN PLANNING THE RED LINE AND MARC RAIL EXTENSION , THE 31 
DEPARTMENT SHALL :  32  4 	HOUSE BILL 632  
 
 
 
 (I) SEEK TO AVOID ANY RES IDENTIAL DISPLACEMEN T;  1 
 
 (II) STUDY THE ECONOMIC AN D EMPLOYMENT IMPACTS OF 2 
CONSTRUCTING AND OPE RATING THE RED LINE AND MARC RAIL EXTENSION;  3 
 
 (III) CONSIDER MEASURES TO PROTECT AND ENHANCE THE 4 
PHYSICAL AND ECONOMI C WELL–BEING OF THE RESIDEN TS OF THE STUDY AREA ; 5 
AND  6 
 
 (IV) MAKE ITS FINDINGS PUB LICLY AVAILABLE .  7 
 
 (3) THE DEPARTMENT SHALL GIVE DUE CONSIDERATION TO 8 
PREVIOUSLY COMPLETED ENGINEERIN G AND ENVIRONMENTAL STUDIES. 9 
 
 (C) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , IN EACH OF 10 
FISCAL YEARS 2024 THROUGH 2027, THE GOVERNOR SHALL INCLUD E IN THE 11 
ANNUAL BUDGET BILL A N APPROPRIATION FROM THE TRANSPORTATION TRUST 12 
FUND OF AT LEAST $5,000,000, CONTINGENT ON THE RE CEIPT OF FEDERAL FUN DS 13 
TO BE USED TO PROVID E MATCHING FUNDS NEE DED TO CONDUCT AN 14 
ENVIRONMENTAL IMPACT STUDY UNDER THE NATIONAL ENVIRONMENTAL POLICY 15 
ACT FOR:  16 
 
 (I) THE RED LINE; AND  17 
 
 (II) A MARC RAIL EXTENSION TO THE JOHNS HOPKINS 18 
BAYVIEW MEDICAL CENTER.  19 
 
 (2) AN APPROPRIATION REQU IRED UNDER PARAGRAPH (1) OF THIS 20 
SUBSECTION MAY BE RE DUCED BY THE AMOUNT OF THE TOTAL AUTHORI ZED IN THE 21 
PRIOR FISCAL YEAR TO CONDUCT THE ENVIRONM ENTAL IMPACT STUDY .  22 
 
 (D) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION AND 23 
CONTINGENT ON THE RE CEIPT OF FEDERAL FUN DS TO BE USED TO PRO VIDE 24 
MATCHING FUNDS , FOR FISCAL YEAR 2024 AND EACH FISCAL YEAR THEREAFTER , 25 
THE GOVERNOR SHALL INCLUD E IN THE ANNUAL BUDG ET BILL AN APPROPRIA TION 26 
FROM THE TRANSPORTATION TRUST FUND OF $200,000 TO THE BALTIMORE CITY 27 
MAYOR’S OFFICE OF EMPLOYMENT DEVELOPMENT FOR WORKF	ORCE 28 
DEVELOPMENT AND SMAL	L, MINORITY, AND WOMEN –OWNED BUSINESS 29 
DEVELOPMENT . 30 
 
 (2) IT IS THE INTENT OF T HE GENERAL ASSEMBLY THAT THE FUN DS 31 
APPROPRIATED TO THE BALTIMORE CITY MAYOR’S OFFICE OF EMPLOYMENT 32 
DEVELOPMENT SHALL SUP PLEMENT, AND NOT SUPPLANT , FUNDS OTHERWISE 33   	HOUSE BILL 632 	5 
 
 
AVAILABLE FOR THE BALTIMORE CITY MAYOR’S OFFICE OF EMPLOYMENT 1 
DEVELOPMENT .  2 
 
 (E) IN CONDUCTING THE RED LINE TRANSIT PROJECT , THE 3 
ADMINISTRATION MAY NO T ACQUIRE ANY REAL P ROPERTY FOR PLANNING , 4 
CONSTRUCTION , OPERATION, OR MAINTENANCE OF TH E RED LINE IF THE 5 
ACQUISITION WOULD RE SULT IN INVOLUNTARY RESIDENTIAL DISPLACE MENT.  6 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That it is the intent of the General 7 
Assembly that the Maryland Transit Administration, in cooperation with the local 8 
governments in the Baltimore metropolitan area and appropriate State agencies, develop 9 
and implement workforce development strategies that maximize participation by residents 10 
in the east–west corridor in jobs created by and for east–west corridor transit projects. 11 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That it is the intent of the General 12 
Assembly that the Maryland Congressional Delegation be requested to advocate changes 13 
in federal law and policy that will: 14 
 
 (1) increase the level of federal funding for and formula participation in 15 
New Starts transit projects to a level consistent with other surface transportation 16 
investments; and 17 
 
 (2) reduce biases in the federal New Starts funding formula against the 18 
northeastern and industrial regions of the United States that have smaller public  19 
rights–of–way and higher utility relocation and environmental hazard mitigation costs. 20 
 
 SECTION 4. AND BE IT FURTHER ENACTED, That it is the intent of the General 21 
Assembly that the Maryland Department of Transportation coordinate any existing study of 22 
the Baltimore East–West Corridor with the activities required under § 7–714 of the 23 
Transportation Article, as enacted by Section 1 of this Act, in a manner that maximizes State 24 
resources and avoids unnecessary steps or duplication of efforts. 25 
 
 SECTION 5. AND BE IT FURTHER ENACTED, That it is the intent of the General 26 
Assembly that, unless it causes undue delay, the activities required under § 7–714 of the 27 
Transportation Article, as enacted by Section 1 of this Act, include extending the Red Line 28 
to the east from the Johns Hopkins Bayview Medical Center into Baltimore County.  29 
 
 SECTION 4. 6. AND BE IT FURTHER ENACTED, That Section(s) 2 of Chapter 2 of 30 
the Acts of the General Assembly of the 2006 Special Session be repealed. 31 
 
 SECTION 5. 7. AND BE IT FURTHER ENACTED, That Section(s) 2 of Chapter 3 of 32 
the Acts of the General Assembly of the 2006 Special Session be repealed. 33 
 
 SECTION 6. 8. AND BE IT FURTHER ENACTED, That Section(s) 1 of Chapter 2 of 34 
the Acts of the General Assembly of the 2006 Special Session, as amended by Chapter 570 35 
of the Acts of the General Assembly of 2009, be repealed. 36  6 	HOUSE BILL 632  
 
 
 
 SECTION 7. 9. AND BE IT FURTHER ENACTED, That Section(s) 1 of Chapter 3 of 1 
the Acts of the General Assembly of the 2006 Special Session, as amended by Chapter 570 2 
of the Acts of the General Assembly of 2009, be repealed. 3 
 
 SECTION 8. 10. AND BE IT FURTHER ENACTED, That Chapter 570 of the Acts 4 
of the General Assembly of 2009 be repealed. 5 
 
 SECTION 9. 11. AND BE IT FURTHER ENACTED, That this Act shall take effect 6 
July 1, 2022. 7
