Strike out indicates matter stricken from the bill by amendment or deleted from the law by amendment. *hb0632* HOUSE BILL 632 R2 2lr0424 By: Delegates Rosenberg, Smith, Attar, and Bridges Introduced and read first time: January 31, 2022 Assigned to: Appropriations and Environment and Transportation Committee Report: Favorable with amendments House action: Adopted Read second time: March 11, 2022 CHAPTER ______ AN ACT concerning 1 Baltimore East–West Corridor – Transit Study – Requirements 2 FOR the purpose of requiring the State Department of Transportation to complete certain 3 processes and secure a certain decision for the Red Line and a certain MARC rail 4 extension; requiring the Department to prepare a certain plan; requiring, for certain 5 fiscal years, that the Governor include in the annual budget bill certain 6 appropriations for certain purposes, subject to the receipt of certain federal funds; 7 prohibiting the Maryland Transit Administration, under certain circumstances, 8 from acquiring real property; and generally relating to the Baltimore metropolitan 9 area east–west corridor. 10 BY adding to 11 Article – Transportation 12 Section 7–714 13 Annotated Code of Maryland 14 (2020 Replacement Volume and 2021 Supplement) 15 BY repealing 16 Chapter 2 of the Acts of the General Assembly of the 2006 Special Session 17 Section 2 18 BY repealing 19 Chapter 3 of the Acts of the General Assembly of the 2006 Special Session 20 Section 2 21 2 HOUSE BILL 632 BY repealing 1 Chapter 2 of the Acts of the General Assembly of the 2006 Special Session, as 2 amended by Chapter 570 of the Acts of the General Assembly of 2009 3 Section 1 4 BY repealing 5 Chapter 3 of the Acts of the General Assembly of the 2006 Special Session, as 6 amended by Chapter 570 of the Acts of the General Assembly of 2009 7 Section 1 8 BY repealing 9 Chapter 570 of the Acts of the General Assembly of 2009 10 Preamble 11 WHEREAS, The Maryland Transit Administration has undertaken the Baltimore 12 Corridor Transit Study – Red Line for a proposed 10–mile rapid transit line for the 13 Baltimore metropolitan area; and 14 WHEREAS, The Red Line transit corridor encompasses a large number of residents, 15 small and large businesses, schools, churches, and other community institutions, all of 16 which are deeply concerned about the future of their communities; and 17 WHEREAS, Effective, high–quality public transportation is important to these 18 communities; and 19 WHEREAS, Public transit must be frequently available, reliable, and safe, and must 20 provide an efficient and economical means to connect community members to major 21 destinations throughout the Baltimore metropolitan area; and 22 WHEREAS, First and foremost, the Red Line should improve the public 23 transportation system in the Baltimore metropolitan area and in the communities 24 surrounding the Red Line transit corridor, and should be planned in a manner to serve 25 those communities and foster economic development; and 26 WHEREAS, It is the intent of the General Assembly that, during the course of 27 planning and constructing the Red Line project, the Administration adhere to the best 28 practices of transit planning and implementation; and 29 WHEREAS, It is the intent of the General Assembly that community members 30 participate in the planning process for the Red Line project and seek to fairly represent the 31 interests of all community members; now, therefore, 32 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 33 That the Laws of Maryland read as follows: 34 Article – Transportation 35 HOUSE BILL 632 3 7–714. 1 (A) IN THIS SECTION, “RED LINE” MEANS A RAIL TRANSIT FACILITY USING 2 ONE OR MORE VEHICLES OPERATING IN TANDEM ON A FIXED RAIL IN A 3 COMBINATION OF AT –GRADE, ELEVATED, AND UNDERGROUND CONF IGURATIONS 4 THROUGH BALTIMORE CITY AND BALTIMORE COUNTY ALONG A GENERA LLY EAST 5 TO WEST ALIGNMENT BE TWEEN THE TERMINUS O F SECURITY BOULEVARD ON THE 6 WEST AND THE JOHNS HOPKINS BAYVIEW MEDICAL CENTER ON THE EAST , 7 CONNECTING AS APPROP RIATE TO OTHER FIXED –ROUTE TRANSIT SERVIC ES. 8 (B) (1) SUBJECT TO SUBSECTION (C) OF THIS SECTION AND CONTINGENT 9 ON THE RECEIPT OF FE DERAL FUNDS , THE DEPARTMENT PROMPTLY S HALL: 10 (I) UNDERTAKE ALL STEPS N ECESSARY TO COMPLETE 11 PLANNING, PRELIMINARY ENGINEER ING, AND THE NATIONAL ENVIRONMENTAL 12 POLICY ACT PROCESS AND SECUR E A RECORD OF DECISI ON FOR: 13 1. THE RED LINE; AND 14 2. A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 15 BAYVIEW MEDICAL CENTER; AND 16 (II) PREPARE A PLAN FOR TH E FUNDING AND FINANC ING OF 17 THE CONSTRUCTION AND OPERATION OF : 18 1. THE RED LINE; AND 19 2. A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 20 BAYVIEW MEDICAL CENTER. 21 (2) IN PLANNING THE RED LINE AND MARC RAIL EXTENSION , THE 22 DEPARTMENT SHALL : 23 (I) SEEK TO AVOID ANY RES IDENTIAL DISPLACEMEN T; 24 (II) STUDY THE ECONOMIC AN D EMPLOYMENT IMPACTS OF 25 CONSTRUCTING AND OPE RATING THE RED LINE AND MARC RAIL EXTENSION; 26 (III) CONSIDER MEASURES TO PROTECT AND ENHANCE THE 27 PHYSICAL AND ECONOMI C WELL–BEING OF THE RESIDEN TS OF THE STUDY AREA ; 28 AND 29 (IV) MAKE ITS FINDINGS PUB LICLY AVAILABLE . 30 4 HOUSE BILL 632 (3) THE DEPARTMENT SHALL GIVE DUE CONSIDERATION TO 1 PREVIOUSLY COMPLE TED ENGINEERING AND ENVIRONMENTAL STUDIE S. 2 (C) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , IN EACH OF 3 FISCAL YEARS 2024 THROUGH 2027, THE GOVERNOR SHALL INCLUD E IN THE 4 ANNUAL BUDGET BILL A N APPROPRIATION FROM THE TRANSPORTATION TRUST 5 FUND OF AT LEAS T $5,000,000, CONTINGENT ON THE RE CEIPT OF FEDERAL FUN DS 6 TO BE USED TO PROVID E MATCHING FUNDS NEE DED TO CONDUCT AN 7 ENVIRONMENTAL IMPACT STUDY UNDER THE NATIONAL ENVIRONMENTAL POLICY 8 ACT FOR: 9 (I) THE RED LINE; AND 10 (II) A MARC RAIL EXTENSION TO TH E JOHNS HOPKINS 11 BAYVIEW MEDICAL CENTER. 12 (2) AN APPROPRIATION REQU IRED UNDER PARAGRAPH (1) OF THIS 13 SUBSECTION MAY BE RE DUCED BY THE AMOUNT OF THE TOTAL AUTHORI ZED IN THE 14 PRIOR FISCAL YEAR TO CONDUCT THE ENVIRONM ENTAL IMPACT STUDY . 15 (D) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION AND 16 CONTINGENT ON THE RE CEIPT OF FEDERAL FUN DS TO BE USED TO PRO VIDE 17 MATCHING FUNDS , FOR FISCAL YEAR 2024 AND EACH FISCAL YEAR THEREAFTER , 18 THE GOVERNOR SHALL INCLUD E IN THE ANNUAL BUDG ET BILL AN APPROPRIA TION 19 FROM THE TRANSPORTATION TRUST FUND OF $200,000 TO THE BALTIMORE CITY 20 MAYOR’S OFFICE OF EMPLOYMENT DEVELOPMENT FOR WORKF ORCE 21 DEVELOPMENT AND SMAL L, MINORITY, AND WOMEN –OWNED BUSINESS 22 DEVELOPMENT . 23 (2) IT IS THE INTENT OF T HE GENERAL ASSEMBLY THAT THE FUN DS 24 APPROPRIATED TO THE BALTIMORE CITY MAYOR’S OFFICE OF EMPLOYMENT 25 DEVELOPMENT SHALL SUP PLEMENT, AND NOT SUPPLANT , FUNDS OTHERWISE 26 AVAILABLE FOR THE BALTIMORE CITY MAYOR’S OFFICE OF EMPLOYMENT 27 DEVELOPMENT . 28 (E) IN CONDUCTING THE RED LINE TRANSIT PROJECT , THE 29 ADMINISTRATION MAY NO T ACQUIRE ANY REAL P ROPERTY FOR PLANNING , 30 CONSTRUCTION , OPERATION, OR MAINTENANCE OF TH E RED LINE IF THE 31 ACQUISITION WOULD RE SULT IN INVOLUNTARY RESIDENTIAL DISPLACE MENT. 32 SECTION 2. AND BE IT FURTHER ENACTED, That it is the intent of the General 33 Assembly that the Maryland Transit Administration, in cooperation with the local 34 governments in the Baltimore metropolitan area and appropriate State agencies, develop 35 HOUSE BILL 632 5 and implement workforce development strategies that maximize participation by residents 1 in the east–west corridor in jobs created by and for east–west corridor transit projects. 2 SECTION 3. AND BE IT FURTHER ENACTED, That it is the intent of the General 3 Assembly that the Maryland Congressional Delegation be requested to advocate changes 4 in federal law and policy that will: 5 (1) increase the level of federal funding for and formula participation in 6 New Starts transit projects to a level consistent with other surface transportation 7 investments; and 8 (2) reduce biases in the federal New Starts funding formula against the 9 northeastern and industrial regions of the United States that have smaller public 10 rights–of–way and higher utility relocation and environmental hazard mitigation costs. 11 SECTION 4. AND BE IT FURTHER ENACTED, That Section(s) 2 of Chapter 2 of 12 the Acts of the General Assembly of the 2006 Special Session be repealed. 13 SECTION 5. AND BE IT FURTHER ENACTED, That Section(s) 2 of Chapter 3 of 14 the Acts of the General Assembly of the 2006 Special Session be repealed. 15 SECTION 6. AND BE IT FURTHER ENACTED, That Section(s) 1 of Chapter 2 of 16 the Acts of the General Assembly of the 2006 Special Session, as amended by Chapter 570 17 of the Acts of the General Assembly of 2009, be repealed. 18 SECTION 7. AND BE IT FURTHER ENACT ED, That Section(s) 1 of Chapter 3 of 19 the Acts of the General Assembly of the 2006 Special Session, as amended by Chapter 570 20 of the Acts of the General Assembly of 2009, be repealed. 21 SECTION 8. AND BE IT FURTHER ENACTED, That Chapter 570 of the Acts of the 22 General Assembly of 2009 be repealed. 23 SECTION 9. AND BE IT FURTHER ENACTED, That this Act shall take effect July 24 1, 2022. 25
